E3 Visa for small company in the US

Hi guys,

I visited the US for three months earlier this year, just as a tourist under the VWP. Whilst I was there I met a guy who was in the process of starting up a company. I told him to contact me if he ever needed an environmental scientist (I have a Bachelors degree in Geology). Anyway, he called me a few days ago and told me he would love to employ me.

I feel that this should entitle me to the E3 visa, right? I am an Australian with a three year degree and a job offer in the US.

The only issue I can see is that the owner of the company is a friend of mine. He also doesn't have any other employees, nor does he have an office. His business is real, and the job is real, but is it enough to qualify for a working visa?

Ideally I would like to do all the paperwork and get the visa before I enter the US so that I don't have to fly all the way back to Australia before starting the job.

Your prospective Employers Lawyer does most of the paperwork.

This employer doesn't have a lawyer though.

The first step then would be to appoint one.

Similar in many respects to a H1B.
