Hi,

I'm an American citizen (got my Citizenship via my husband0. I received recently Green card approval for my mother. I already paid the (AOS) fees on line and sent the DS-3032 by mail. Now they want me to fill one of the I-864 forms (I-864, I-864EZ, I-864A, I-864W)!!

I'm confused and I do not know which of the above forms I need to fill especially that I do not know who can sponsor my mother (me or my husband) ?

Please note:

I'm a house wife and I never worked in USA. My husband is the only one who is working, has a good income, we are both our house owners , and file joint Taxes yearly.

Which form out of the above I need to fill?

I filed i-864 for My mom too. It's important that you read the I-864 instructions. What I know is that because you're not working your husband must co-sponsor your mother. You have to fill it out but your husband has to co-sponsor this petition. Pay stub las six month, letter from employer, three income tax from las three years and I-864 done

You are the petitioner, therefore you are the primary sponsor. The primary sponsor must sign an I-864. Your husband can sign an I-864A to help you qualify.

Thank you both for your help!! I will use (I-864) and (I-864A).

-1--Can you please tell me what papers I need to send to proof my relations to my mother /and do they need to be original or copies?

-2-- Do I need to include 2 photos of myself and 2 photos of her?

((I’m confused and still can not find detailed information about what I need to send along with the above forms. I read the check list on there web site but it is not detailed))

If your petition was approved and you've already gotten the affidavit of support fee bill, which you said you've already paid (though how you did this without submitting the affidavit is unknown to me), then you should have already proven she's your mother. They wouldn't have accepted your I-130 if you hadn't proven that.

I'm confused. What stage of the process are you at?

I applied for:

1-I-130 for my mother.

2-After 8 months I received by mail (I-130) approval + a letter from the immigration asking me to pay the (AOS) fees on line and to sent them the DS-3032 by mail. (Which I already did)

3-Now on my AOS payment page on the immigration web site I got direction to fill the I-864 forms.(I'm trying to do that now but I'm a little bit confused!! that is why I'm asking many questions :)

I second this (I think) im also confused with this, i called and proposed my situation to te reps at the nvc and got 2 diff answers....my uncle who lives int eh same household that doesnt have me as a dependent will be my co-sponsor. I called and said that to one person they said he need to do the i-8864 like i was doing then i called again the other person said he needs to do the i-864A then i read a bit more into them and the i-864A is for combined income in a household....so I think im going to go with that one.....but will call one more time to break the 50/50 slit in answers i got some the nvm reps...smh this is a pity that i got a 50/50 answer split. THEY ARE SUPPOSE TO KNOW THIS INSIDE OUT!!

Dec 02, 2011- Went to the Local Reps office to have them look into the case further

Dec 07, 2011- Wrote email to the vermont service center ( the got back to me Dec 20, of course to tell me I was approved due to the congressman's inquiry)

Dec 08, 2011- Congressman/Local Rep's inquiry made

Dec 09, 2011- USCIS Text/Email with approval (NOA2) 6 months and 2 days

Dec 14, 2011- Receive NOA2 Hardcopy

Hi again,

I already paid today the IV fees ($404) for my mother's Green card. Now I'm filling the ( I-864) and (I-864A/Because I never worked in USA).

does any one have an idea what should I wirte in the,

Part 6. Sponsor's income and employment:

Do I need to say I'm unemplyed since.....(please note that I never worked in USA) Or do I need to leave part 6 empty and only let my husband fill the (I-864A)

Your uncle can't submit an I-864A. The I-864A is for a qualifying household member or a dependent of the sponsor. A qualifying household member must be related to the sponsor as spouse, adult child, parent, or sibling. Your uncle isn't related to you in any of these ways. He must sign an I-864.

The customer service reps for most US government agencies are trained in less than a week. They aren't trained in the laws and policies of the agency they work for. They are trained to use a customer service computer system. If they don't ask the computer system the right questions then they won't get the right answers.

Check box "d" for question 22, and write the date you arrived in the US. Write $0 for question 23. Write $0 for question 24, line "a". Write your husband's name on the first line for question 24, part "b". Relationship is "spouse". Write his income from the I-864A.

On the I-864A, be sure you fill out and sign part 2, sections 13 and 14. Be sure your husband fills out and signs part 3, sections 15 and 16. The I-864A requires that you include proof that the household member is a qualifying relative (your marriage certificate should suffice), and proof that the household member lives with you.

I still have afew more questions please,

1-Regarding Form I-864:

Question 25. Federal income tax return information,

Do I need to leave it empty as I'm not working and my husband is the joint sponsor? I'm confused because we do file a joint income tax return yearly.

2-Regarding Form I-864a:

Part 1. Information on the Household Member. (You.). Is that me (PRIMRY SPONSER) or my husband (JOINT SPONSER)?

3- When I send the I-864 and the I-864a what more do I need to include besides the follwoing ,

copy of my last year tax return.

Marriage certificate.

Proof that we are sharing the same address (driver licenses , joint bank account and joint property).

Proof that my husband is an American citizen (copy of his passport and my passport).

Enter the amount from your joint tax returns. As the form indicates, this should be the total income if you filed a 1040 or 1040A, or adjusted gross income if you filed a 1040EZ.

The household member is your husband. You, the primary sponsor, fill out and sign part 2 of the I-864A.

I appreciate your help. I’m almost ready to send the I-846 and I-846A tomorrow but we have a problem,

Our marriage certificate (we got married in our country) has my old husband’s first name. After he became an American citizen, he changed his first name. I know that I can provide a court copy of his name change but he can not find it anywhere (he never used since long time ago).

Now what to do to proof that we are a husband and wife? He is telling me that our joint Tax income is more than enough to proof that we are a husband and a wife.

I hope you can give us your input regarding this issue?

I suggest he contact the court clerk where the name change was granted. They should be able to issue a certified copy of the court order granting his name change. A joint tax return is not proof that you're married. It's proof only that you claim to be married to the IRS.

Hi, thank you for your always help!! I mailed the I-864 and the USPS confirmed that it arrived to the NVC but I'm not sure if they approved it or not yet? are they going to contact me by mail or Can you please tell me how can I track my I-864 status?
