RE ENTRY I- 131 HELP PLEASE

HELLO EVERYONE

OK SO RIGHT NOW MY HUSBAND HAS HIS GREENCARD. HE HAS HAD IT FOR ABOUT A YEAR NOW. A COUPLE MONTHS BACK HE GOT OFFERED AN AMERICAN JOB THAT WAS BASED OUT OF HONDURAS. SO WE TOOK IT. I CALLED THE IMMIGRATION OFFICE AND SPOKE TO THE LADY THERE ABOUT OUR SITUTAION AND SHE ONLY SAID THAT WE SHOULD RETURN EVERY 6 MONTHS AND IF IT WAS LONGER WE COULD APPLY FOR A RE ENTRY PERMIT AND STAY FOR UP TO TWO YEARS. SHE SAID WE COULD APPLY IN THE US BUT LEAVE BEFORE IT WAS APPROVED AND THEY WOULD SEND IT TO THE EMBASSY HERE IN HONDURAS. I HAVE ALSO CONFIRMED THIS ONLINE. HOWEVER SHE FAILED TO MENTION THAT HE WOULD NEED BIOMETRICS. OUR PLAN IS TO STAY HERE FOR ONLY 1.5 YEARS AND WE WILL CONTINUE OUR LIVES BACK IN THE USA AFTER THAT.

WE HAVE BEEN OUT OF THE COUNTRY FOR 4 MONTHS AND HE IS PLANNING ON RETURNING NEXT MONTH BEFORE THE 5 MONTH PERIOD TO APPLY FOR THE PERMIT FOR ONE YEAR. HOWEVER HE WILL ONLY BE ABLE TO BE GONE FROM WORK FOR A 8 DAYS. THIS OFCOURSE IS NOT ENOUGH TIME TO SEND IT IN AND ALSO GET THE BIOMETRICS IN. SO I HAVE TWO PLANS AND WANTED TO KNOW IF ANYONE HAD BEEN THROUGH THIS OR KNOWS THE ANSWER TO THEM

1. MY FAMILY IS VISITNG ME IN 3 DAYS AND WE CAN FILL OUT THE FORM AND HAVE THEM MAIL IT FROM HIS RESIDENT ADRESS AND THEN WHEN THEY SEND THE APPT FOR THE BIOMETRICS HE CAN FLY BACK AND TAKE THEM AND FLY BACK TO WAIT FOR THE APPROVAL .. PROBLEM SOLVED.. BUT I HAVE HEARD THAT YOU MUST BE IN THE COUNTRY TO FILE.. IS THIS SO YOU CAN DO THE BIOMETERICS OR IS THERE A CERTAIN REASON. HAS ANYONE FILED ABROAD AND DONE THIS??? HOW DO THEY KNOW YOU ARE OUT OF THE COUNTRY?

2. SEND THE APPLICATION WITH MY FAMILY. HAVE THEM MAIL IT 2 OR 3 DAYS BEFORE HE ARRIVES SO IT ARRIVES AT THE OFFICE WHEN HE GETS BACK IN THE USA.SO IF THEY CHECK THEY WILL SEE HE IS IN THE USA. THEN GO MAKE AN APPT AT INFOPASS TO SEE IF HE CAN JUST DO A WALKIN BIOMETERICS? WITHOUT AN APPT.. MY QUESTION IS HOW LONG AFTER THEY RECIEVE IT CAN YOU TRY THIS.. DO YOU HAVE TO WAIT FOR THEM TO GIVE YOU THE APPT BEFORE YOU TRY A WALK IN??

IF HE CAN'T DO EITHER ONE.. WHAT ARE OUR OPTIONS? HE CAN'T STAY ANY LONGER THAN THE TIME ALLOWED FROM WORK. WE ARE TRYING TO DO THE RIGHT THING AND GET THIS PERMIT INSTEAD OF COMING BACK EVERY 6 MONTHS AND RISKING IT.. ANY SUGGESTIONS.. ALSO DOES ANYONE KNOW HOW HARD IT IS TO GET YOUR GREEN CARD BACK IF THEY TAKE IT AWAY??? THIS IS NOT SOMETHING WE WANT TO GO THROUGH, WE ARE MARRIED AND PLAN ON SPENDING OUR LIVES IN THE USA ONCE THIS JOB IS OVER...

WHAT HAPPENS IF THEY DENY THE PERMIT DO YOU RECEIVE YOUR MONEY BACK? CAN YOU APPLY AGAIN?

For the re-entry permit application, I think the applicant has to both be in the country when USCIS receive that application and for biometrics, but can leave between those 2 dates, however I'm not 100% sure, can someone verify this? They know when you are in and out of the country...

Walk-ins for biometrics is a gamble, some have success, some do not. I think you'll need the actual appointment letter to do biometrics though. Fees are never refundable with USCIS, even if they make an error.

If your husbands GC is conditional (valid for 2 years) then the re-entry permit will expire with the GC. We are in a similar situation with my wife's GC and we plan to try an remove conditions from abroad. If were unsuccessful, we'll go through the DCF process in Italy to obtain another GC when we move back to the USA.

Most of all, don't rely on your company's HR to give you correct answers as they have no stake in it. Verify everything they tell you...

Ok thanks for the help. I am a little confused about the last part. His is a conditional GC. What happens when it expires you can't renew it?
