Actually you SHOULD have listed your ex-wife and her son unless they are now USC's because they are counted in your household size. Have a read of the I-864 instructions (though you complete the i-134 the I-864 instructions explain household size better). You better fix this or you could be accused of lying to immigration.

Its been well over 10 years. I'm not worried about it. They are litsed as me having Filed for them but they are not listed as dependant on me. Again, I'm not concerned.

He filled out the I-134, which doesn't even ask if the affidavit of support is still enforceable. It only asks if you've ever submitted an affidavit of support before and if you've ever petitioned for anyone before, and requires you to list those persons. He should have listed his ex-wife, regardless.

They are both listed as me having filed for them but they are not listed as dependant on me. They are both USCs now and its been over 10 years anyway.

I think you're getting section 8 confused with sections 9 and 10. Section 8 asks you to list your dependents. Section 9 asks you to list everyone you've ever submitted an affidavit of support for. It doesn't ask you to list them only if the affidavit is still enforceable. Section 10 asks you to list everyone you've ever filed a visa petition for.

08/18/2010 - AOS Interview - APPROVED!

Section 8 - My daughter that I have with my ex is listed. Only her.

Section 9 - My ex is listed and so is her son as I have filed AOS for each of them over 10 years ago.

Section 10 - My current fiancee is listed. My ex and her son are not.

I asked the peoplpe at the k-1 VISA service I use about this, because I was confused. And this is what they told me to do based on the information I gave them about the situation.

Why Charles, I think the missing post provided the best answer and solution to the issue.  :rofl:

Now in all fairness to the ex-wife the MOD should eliminate the OP's threads in which she started the name calling of the ex-wife outside of her legally given name.

I don't believe anyone's BC has their name listed as witch or BIxxx.

Actually, in fairness to all parties involved and since the OP has received her answer - it is probably best that this thread is closed to further discussion, so that is what I am doing- closing this thread.

I can't help but think of the old adage, though, about glass houses.

“...Isn't it splendid to think of all the things there are to find out about? It just makes me feel glad to be alive--it's such an interesting world. It wouldn't be half so interesting if we knew all about everything, would it? There'd be no scope for imagination then, would there?”
