HI EVERYONE

JUST RECEIVED OFFICIAL APPROVAL NOTICE FOR 129-F, I CALLED TONITE AND WAS GIVEN CASE NUMBER , THE PERSON THAT I SPOKE WITH SAID THAT PACKET WILL BE SENT TO BOGATO EMBASSY SHORTLY, LOOKS LIKE THINGS ARE FINALLY MOVING ALONG. I EXPLAINED TO HER THAT , MY FIANCE WAS PLANNING ON LEAVEING HER SON IN BARRANQUILLA ,FOR A COUPLE OF MONTHS AND THEN WE WOULD GO BACK DOWN AFTER OUR MARRIAGE TO BRING HIM HOME , SHE SAID SHE WASNT SURE IF WE WOULD BE ABLE TO BRING HIM BACK ON ADVANCED PAROLE ,BECAUSE SHE WOULD NOT BE MY FIANCE ANYMORE , BUT MY WIFE ? MY QUESTION IS ,RUBIN IS LISTED ON 129-F AND ALL OTHER PAPERWORK, AFTER WE ARE MARRIED , WHAT IS THE QUICKEST AUTHORIZATION , FOR US TO LEAVE THE USA AND COME BACK WITH RUBIN, ADVANCED PAROLE-AOS OR ARE THEY ONE IN THE SAME ? IF WE ARE GOING TO COME BACK TO USA WITHOUT RUBIN, IS THERE OTHER PAPERWORK THAT WE NEED FROM EMBASSY OR IF HE IS ISSUED A VISA ALONG WITH HIS MOTHER, THERE IS NO PROBLEM ? HOW LONG DOES AOS OR ADVANCED PAROLE TAKE ? THANKS JON

Jon - could you turn your caps off. Looks like you are screaming. I know this process will make you scream, but please....LOL

You didn't give us enough info. Did you file a K-2 petition for her son?

To answer your question generally and simplistically- Adjustment of Status (AOS) is the process of filing and getting the green card (becoming a conditional permanent resident). Advance Parole (AP) is a travel document issued to allow the immigrant to travel out of and re-enter the US in the interim period from filing AOS and the green card being granted.

You file AOS and AP concurrently. AP is typically granted in less than 90 days (if your paperwork is correct) and AOS could take as little as 4 months but more likely close to a year.

You called where tonight? In any event, does your fiancee plan to apply for her son's K2 visa at the same time she applies for her own K1? If so, she'll have 6 months from the date the visas are issued to get back to her country and leave again with her son.

That means that she'll want to enter the USA promptly after receiving her visa, and you and she will want to marry promptly after she enters the USA. Then she'll want to apply for her adjustment of status and advance parole without delay.

Time can pass quickly, don't waste any of it.

Is there a compelling reason that Rubin will not travel at the same time as his mother? It seems to me you are taking a big risk in hoping that you will have no delays in getting married and collecting all the required documents and applying for the AP in time to go back for Rubin. I see most posters here getting it within 2 - 3 months of thier AOS submission, but I also see a few stray complaints about not getting things on time to meet their plans. What happens if someting is misplaced bye USCIS and months after your submission they send you an RFE to resend a document? I suppose if the time got close you could always make an Infopass appointment and ask for an emergency AP, but those aren't guaranteed either.
