Clarification

I received my I-797C in the mail today. I just want a little clarification.

First paragraph says that my conditional resident status has been extended for a period of one year... so on and so forth. Im clear on this.

Second paragraph says in order to process my petition, i will be receiving a biometrics appointment notice. Im clear on this.

Third paragraph says:

"Note: Conditional resident applicants, including dependents residing overseas will not receive a biometrics appointment. To complete biometric processing these applicants must submit the required items listed on the I-751 form instructions.

Fourth paragraph says:

"If you have not already done so, provide supporting documents to assist USCIS in processing your petition and to establish eligibility to remove the conditional basis of your permanent residence. PLEASE INCLUDE A COPY OF THIS RECEIPT NOTICE WITH ANY SUPPORTING DOCUMENTS YOU SUBMIT. Such evidence may include, but not limited to, the following items:

-Lease of joint tenancy

-Joint mortgage agreement

-Tax returns

-Birth certificate of children

-Joint insurance policies

My question is: Does the fourth paragraph refer to me or it refers to conditional residents who are overseas? I guess Im being paranoid coz I know I sent all supporting documents together with my application but how do i know that they received and did not lose the supporting documents and that they are not asking for it again? Can somebody please give me clarification on this. Thanks.

Hi Visacheck, we all, who are removing condition on a 2 yr green card recieved that letter. The letter itself is a reciept telling you that USCIS has recieved your application. I-797C is NOA1. It also says, in the letter that, if they require further document they would ask for it. Asking for further document menas something extra they want to see as evidence. In about a month or so you should recieve a letter saying ASC Appointment notice. That would be your biometrics appointment notice.So right now you can relax and wait for the biometrics letter and hope the best.

N.B. you can check your case status online with your Biometrics letter application number.

Thanks for your quick reply christera22. I was aware that the I-797c is a receipt notice. What threw me off a little bit was the paragraph that says i need to submit supporting documents coz I wasn't sure if it was referring to me or if it was for people overseas or if it was a generic statement. So i guess if they need more documents they will send me another notice in the mail correct?

I got the exact same letter, including the paragraph that threw you off, so I assume this is just the/a standard NOA1 format.

Mine (from VSC) is written slightly differently but has the same poor wording. I think there's a comma missing and it's meant to read: "Conditional resident applicants, including dependents, residing overseas...". In other words, it applies to active military personnel (including their children) removing conditions from outside the USA rather than all conditional residents (in the US or otherwise) and dependents residing overseas. Commas can change everything
