Timeline

We were approved May 27th for 129f visa. Paperwork is now being sent to the Chinese consulate. Happy happy happy......

My question is on the hard copy approval I got in the mail it says approval notice valid from May 27th to Sept 27th. What happens if the interview isn't completed by then? Or they require additional info? Can I get this extended? How?

If the embassy does not schedule the interview in time, they will automatically extend the validity.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Timeline

The consulate will notify the beneficiary when they receive the petition from NVC - on VJ this notice is routinely called packet 3. If the beneficiary doesn't respond before the four month validity of the petition has expired then the consulate will send a second notice to the beneficiary, as well as a notice to the petitioner. If they don't receive a response within 60 days then the petition will be considered abandoned, and returned to USCIS. 9 FAM 41.81 N6.1

The consular officer can extend the validity of the petition approval in four month increments any number of times. If the consular officer believes that the petitioner and beneficiary no longer intend to marry, or if no action has been taken on the visa application for one year, then the petition will be considered abandoned and returned to USCIS. 9 FAM 41.81 N6.2

Ok, that's what the consulate is supposed to do, according to their own Foreign Affairs Manual. Is that what they always do? No. Your best bet is to stay proactive. If you know the consulate has your petition and you haven't received the packet 3 notice in a reasonable amount of time then contact them, especially if you live in a country where local mail service is spotty. If they say they've already sent packet 3 then it's usually safe to go ahead and send your response.

As long as you stay in contact with the consulate then they'll extend the validity of the petition approval. If you drag your feet too long then they may want to see new letters of intent. If you drag your feet for more than a year then the petition will be sent back to USCIS.
