how much time it will take for the next interview pleas

My view of your situation is that it is a little complicated, considering the answers that you provided. I believe simply learning more stuff about each other will not help. In fact, while your lack of knowledge may played a role in the rejection, the age diffeerence especially considering that you are male younger than female from a culture where males are older than females in marriage, may be even more important problem. What may happen, given the situation, that you will wait for another year or more after re-submitting the CR1 and still will not get it (most likely). The only way under the circumstances that you may convince CO is her moving there.

so how she will contacte Senator/Congressman and if i want to call the consula to ask about why they found me ineligible that a good or bad idea

and she called the consula yester day and they told her to call again wensday if she want talke about interview and she sent a email to them saying to them why they found me ineligible and why they ask me about religion

Dont get stuck on the religion.... they asked you her hobbies and you told them she like to read Bible so Co never asked you about your religion or her religion.

Then the follow up questions as to what church se attends etc.

As most ppl have requested you, you need to sit down and think of all the questions that they asked you and the response you gave and if you feel comfortable you can share with ppl on here and they can tell you what went wrong.

They did not deny you based on religion, they denied you based on whatever they have on file and what you answered did not match.

how much time it will take for the next interview pleas

I would think in terms of a year. Unless your wife can spend several months with you between now and then, you can probably expect a similar result. Time spent together in person is the best evidence of a genuine relationship. With your three big items counting against you, reverse age difference, different religions and having failed the first interview, only significant time together will overcome the initial denial, IMO.

i just talke with my wife and she call an agent with the Dept of State and she told her when you recieve a form marked Section 221 g it means that they are not making a decision in the consula at this time and they are sending the case back to the US Homeland Security to further research and make sure everything is in order before a decision is made. She said the Embassy does the interview but doesn't always make the decision.

Therefore the case will be sent to US Homeland Security and when they recieve it we will be sent a reciept number and will be able to track the progress of the decision online and at that time it will be determined whether more documents are needed or the Visa is complete for approval.and about the answer i told them about i dont know hat type of diploma she have it was a good answer cus they have only on type of it and that good i told them i donk know becaus i think he only want to know if i will lie

I wouldn't have hopes up. The fact that they are sending it back in 99% cases means that they will let it expire. Please, listen to what people suggest here and follow the plan.

The information in the first paragraph above is just another way of saying what you already know. However, you will not receive a receipt number or new case number from USCIS when they get the case back. (Dept. of State operators don't know USCIS procedures.) A few months after USCIS gets the case back, they'll contact the petitioner and give them an opportunity to rebut the reasons given by the Consulate. Once the rebuttal is received, USCIS will determine whether or not to reaffirm the petition approval and send it back to the Consulate to deal with a second time.

In rare cases USCIS will reaffirm without need for petitioner input. In the meantime, I would start making plans to spend significant time together abroad.

Your case will go back to the fraud unit. They will decide the next step. Like someone else mentioned here, write down all the questions and answers that were given at the interview. At this point you can't do much. Attacking the consulate will not help.

This is my opinion you are telling you answered all the questions correctly, but to me that does not sound very convincing.

Something might sound right to you does not mean it would follow the same with CO, for example: you said you answered what is her favorite part in Bible……..I have no freaking clue what part in Bible does my wife like nor would I care that her personal thing.

You see that’s what I mean if something like this was presented to CO he would definitely take this interview for a canned interview where all the answers were prepped.

You could tell her favorite part in Bible, but you did not know what her degree was….. hmmm does not sound good dude.

I already mentioned suggested plan. There is no other plan. I would try to end the case as soon as possible to be able to file another case. Don't keep rebuttling it. Lawyer will tell you that they can do this but in this case they won't. They will just take your money. Senator/Congressman will not help in this case either. You have 3 options:

1) If you are truly in love end the case, ask her to move there as there is no other option, spend at least 3-4 months together, re-file new case

2) Same but not in Morocco but rather 3rd country

3) You will not have a chance otherwise.

I do not see any other high-probability option.

I will be brutally honest: considering your respective age groups and answers that you are given if I was CO I would reject it too. Now the ball in your aqnd your wife's court to prove them wrong.

No one here knows where your wife lives so we can't give you the number for her senator. She can look up his information online. You can't call the senator and request anything since you are not the constituent, only your wife will be able to do that and she must give them written permission to request information on her behalf. As I posted earlier, she needs to go the her senators website and fill out the release form to get that process started. But as others have stated, there is almost no hope that the case will be held at the consulate. It will go back to USCIS where they will notify your wife, then make a decision on whether to resubmit the petition to the consulate or to reject it. You are both looking at a very long drawn out process now.

In our case, before the interview, I sent my wife two pages of information for her to study for the interview. Everything from family names, birthdates and locations to my education, work, hobies, details about my car, house, neighborhood and city and anything else I could think of. We went way overboard on info and they still asked a question that we hadn't thought of.

I wouldn't have hopes up. The fact that they are sending it back in 99% cases means that they will let it expire. Please, listen to what people suggest here and follow the plan.

If the OP's wife filed an I-130 and the OP was interviewing for a spousal visa, then the items you have written here are not correct. Spousal visa petitions never expire.

OP, what visa were you seeking, CR-1? Spousal visa petitions sent back by Embassies/Consulates are reviewed by USCIS and then one of the following 2 things will happen:

  • USCIS reaffirms the petition
  • USCIS will send a Notice of Intent to Revoke (NOIR) to the petitioner (the OP's wife in this case)

Also, if your wife receives a NOIR, she MUST respond to it. If a NOIR is sent, it will specifically state the reasons why it is being sent; your wife will have the opportunity to send rebuttal evidence. There will be a deadline that she will have to respond to the notice.
