Should he pay my rent?

I'm surprised there are so many people who say "Don't leave your house, it's your house too".

How do you know that? Is it owned property or do they rent? Is it in his name or in both? Is there a prenuptial?

The OP doesn't state anything of this and without knowing these things, you can never state for certain that it is 'her house too'. Just imagine he owns the house and made her sign a prenup, then it could be that it will never be her house and that he is entitled to kick her out.

She lives there, it's her house. He cannot throw her out on the street and be legally justified for doing so. I'd imagine there are laws against it.

For instance, in FL, when one spouse owns a property (even if they owned the property before they met/married), and that spouse wants to sell the house...if it's the couple's primary domicile, and the non-owning spouse lives in the property, that spouse would have to sign the sale papers. Meaning, that spouse has rights to the house, regardless of not actually owning it.

No one is entitled to simply 'kick' someone out. Not even a landlord whose tenant hasn't paid in months. People have rights, and there has to be a legal channel to go through to get her out.

I just wanted to chime in and say up until last year my credit was practically non-existent and have had no trouble renting with no credit for the last 18 years. I think it's poor credit that becomes the problem.
