Hi, I am currently in J1 status (not subject to 2 yrs home residency) and I have got the admission to a graduate school Fall 2011(This school charges SAME tuition for in-state residents and international students).

My boyfriend's EB2 PD is current now and we are planning to get married and file i485 soon.

I just have a few questions regarding this. and I will greatly appreciate any advice and suggestions.

(1) So if I get married this month and file 485 asap, when will I get the AOS status? From the date I file 485 or from the date I get the receipt of 485?

(2) I applied for admission to that school last year as international student and they are processing an I -20 for me now. the i20 will probably arrive in 2-3 weeks. But if I become AOS in July (for example), can I register in late August as a full time student with AOS? If I can, do I need to do anything with the I-20?

(3) If my 485 is rejected during my graduate study, is there anyway that I stay and finish my degree (it is a one-yr master from Fall 2011-may 2012)?

I will greatly appreciate any advice and suggestions.

Hey, I also applied for grad school as an Intl student, and got accepted for this fall. When I got accepted, I told the school not to issue me an I-20 as I was already currently adjusting status from a K1 visa. I had to explain all of this to them. They told me that I would need my GC in order to enroll and that having applied for AOS was not enough. You may want to talk to the international student liason in your school to explain your case so you can figure out which path is the easiest and quickest for you, they are usually very helpful. I am just hoping that all will be well and my GC arrives by mid-August which is enrollment time. I think I still have time and I don't need to panic yet. lol. Goodluck on your visa journey and your studies!

Thank you for your reply.

I have contacted the international office and they suggest register as F1 first and then change into AOS. However, my BF want to file 485 soon and I also prefer to make the change before the school starts.

Good luck on your GC and your study too

AOS means "Adjustment of Status" and you would adjust your status to LPR (legal permanent resident). Some of your post doesn't make sense 'cause it's using the wrong terms.

Also, you should post here: http://www.visajourney.com/forums/forum/112-bringing-family-members-of-permanent-residents-to-america/ because you are are attempting to AOS based on marriage to an LPR (if he were a USC it would be a different forum).
