hello-

im currently working on a I-864 and stumped as to what to do about question 24. i am a USC and my husbands #1 sponsor, his co-sponsor is also filling out a I-864 and is well above poverty level. However, the co-sponsor filling out the form has a wife whom he files taxes jointly with, she is above poverty level herself without him.. does she need to be included on the number 24B list because they file together, he makes enough to not need to use her income.. however, i was confused as to weather i should add her and make her fill out a form just because they file jointly...

so basically do i need to make my husbands Co-sponsors wife fill out a i-864a form, whatever that is???

The joint sponsor includes his wife (and anyone else) in lines 21b - 21g. If the joint sponsor's income is sufficient then their spouse would not be entered on line 24b.

The joint sponsor uses their individual income amount for the I-864 regardless of how they file their taxes.

I am confused on how a married person is suppose to fill this form out too. Looks like if your co-sponsor's wife is included in #21c then he will need to put her in 24b. The form asked for individual income then income from 1040 which is filed jointly. It also asked if the wife listed has an i-864A on 24d. I would call them and ask.

Hey im sorry I cant answer your question, but Im confused about the I-864 too... What do you mean by co-sponsor? Someone else can file that? What are the "poverty levels" you speak of?

Poverty Guidelines 2011

You can have co-sponsors if your income does not meet 125% of Poverty.

24b is about combining income to meet the requirement. If the joint sponsor meets the requirement then a spouse's income is not needed.

A joint tax return is made up of two separate incomes. Simply determine the joint sponsor's individual income for past years as well as for the current year.

I am also confused on this as well... Im using my aunt as a co sponsor but her and her husband both own a restaurant and they file their taxes together with the restaurants name...does anyone have any idea what I should do?

i see im going to have to look at these forms again..but thank god they not count brother n law with my sister i don't want to have to ask him for nothing..lol

It's really best to start your own thread for your own affidavit of support circumstances. It helps avoid confusion. For the OP, if the sponsor's individual income is sufficient, they need not list any income from their joint tax filing spouse or provide an I-864a for them. However, they will need to state only their personal income as current income and as their past income in the previous income section. Transcripts cannot be used in this situation, so the complete copy of at least the one tax return is required, so the INDIVIDUAL income can be determined.

Other posters, please start your own thread and describe your situation and ask questions there.

so if my parents file jointly, but my mom makes well above the 125%, my dad won't have to fill out the 864A or another 864 right, just be listed in the household portion???

Could anyone please help me with answering question 24 on form I 864? I am the petitioner but I am currently unemployed, filing form I-864 together with a co-sponsor for my spouse as part of I-485 AOS.

So on my I-864 form, should I list my annual income as 0.00 and annual household income as 0.00 also?

And on my co-sponsor I-864, should she list her annual income and her own household income?

Should we or should we not list the other person on question 24b?
