does it make any difference if you file early?

My green card expires on August 8th. I haven't done any paperwork yet. I'll do in this month but I don"t know why people are in rush too much. Is there aything that I don't know? What difference does it make if you file early or late as long as you are in the right time window? I understand they remove your condition a little bit later if you file later, but does this make any difference?

If you file early they will send it right back. If you file late(after your GC expired) then they can have you deported. So it's best to file early within the 90 day frame of your GC expiring.

01/2006 - Filed k1(1st time)

04/2006 - Interview (1st time) denied

06/2009 - Filed k1 (2nd time)

09/2009 - NOA 2 approved

12/2009 - Interview (2nd time) APPROVED! VISA ISSUED

What do you mean by 'change anything'?

The only thing it might change, is when they can begin processing it. As long as you don't leave it so late that they receive it too late because then you risk being deported.

As the previous poster said, file within the 90 day window. That is your requirement. They send these requirements to you when you receive your 2 year GC. I just got mine. It is very clear that they must receive your paperwork before your GC expires. It is also clear that you must not submit the paperwork sooner than 90 days prior to the expiration date. Any time within the 90 days is fine.

Is that what you are asking?

Thank you. I definetely understand that. I meant let's say both our gc expire in August. but you filed yours in May and I filed mine in june. Do you have any advantage because of filing earlier than me. or do i have any disadvantage because i filed later than you.

I don't think so. I just think you have to make sure you file when you are ready.

When I have to apply, I will definitely file at least a month before because I would worry about it getting therewith plenty of time.

Filing earlier in the 90 day window just means they will get to your case a bit sooner, than if file a month/some weeks later. So in my view, it doesn't really make a difference (we are already with our family, and once we have filed I-751 and receive the NOA1, we are authorized to stay one year longer, so what's the rush?).

However, the only reason I see to not wait until the last minute, is just in case something goes wrong with your application, for whatever reason (you forgot to include a check, it bounced, problems with USPS sending your stuff, you forgot to sign the I-751, etc.), you would still have a chance to rectify that. If I am not mistaken, they only consider your application filed, if it is accepted by USCIS.

that is what i thought. one of my friend told me i should send it asap but i don't like being in rush..but i will definetely send the package a month before the gc expires..thank you all! i appreciate all you responses..

Quite frankly, provided you submit the ROC and USCIS acknowledges it with the NOA stating that your residence has been extended for a year if presented WITH the expired card, you are covered for plenty long enough not to worry about deportation.

Other than getting a load off your mind by submitting the paperwork at the start of the 90 day window, and being done with USCIS for 10 years (Hallelujah) I can't see any reason to panic over when in that timeframe your application is mailed in.

if you file within the time, you'll be fine. now why some people file earlier? I personally prefer to get things done and not leave anything hanging, if I have to do it let me do it now to get done with it! if you have the time, gathered documents and money why not?

Agree. we are going to visit my husband's family in FL. We'll fly this friday, but i am not sure if i can prepare all the paperwork by friday. my GC expires on Aug 8th. but if i send my package in the first week of the July I'll be still fine. Right? In that case i can also attach pictures from FL vacation..pix with my husband's family..

Of course you'll be fine if you file in July, as long as its before the day your GC expires. Attaching pictures is a good idea :)
