I am getting way out in front of myself, since I have only gotten an NOA1 on my K1 - But this site is really helpful in finding out what is so hidden. So my question is what is the AOS fee ? Does it vary ? For what its worth my fiance is in Vietnam - all I know from the statistics is I am in for a very long wait. Hopefully they wont charge more ...

There is no variance on the AOS fee based on fiance's original country of origin.

AOS fee $325

Biometrics fee $70

If you file for Advance Parole at the same time, there's a $170 fee, and if you apply for Employment Authorization at the same time (or after filing AOS), there's a $180 fee.

When your fiance/fiancee arrives in the US he/she will not be able to work until:

A ) they get a temporary EAD (work Authorization) at their POE (which few do JFK is one of them that does). The temporary EAD is only good for 90 days from the date of your entry to US and then it will expire.

B ) Applies for a 1 year EAD

c ) waits till they receive their 2 year conditional greencard.

Also your fiance/fiancee can not leave the US unless they:

A ) Apply for AP (Advace Parole)

B ) wait till they receive their 2 year conditional greencard.

Basically the EAD and AP allow you to work and leave the country prior to receiving your greencard. In some cases it can take a year to get your greencard and your EAD and AP usually take about 3 months or so ...

It comes down to your situation if your fiance/fiancee will need to work prior to getting their green card or if they would need to return to their home country prior to getting their greencard.

Once you receive the greencard the EAD/AP are no longer required ...

Thank you so much for the explaination. My only concern would be if it added to the processing time. If it does not, then it seems a very wise decision. Thanks again
