EB 3 visa (nurse) state of ILLINOIS

i am just wondering.. My employer (Oakbrook, Illinois) filed an EB 3 visa for me which has a priority date APRIL 15, 2011. My lawyer informed me that if i get lucky i could just wait for a year SINCE the state of Illinois is passing 3 bills for shortage of nurses..(has a big chance to be approve this year he said) and a maximum wait of 2 years.. i was all jumpy when i heard, i only had to wait this short.. but as i have been searching online the more i read the more sad i get..

Can anyone please tell me that is it even possible??? i filed when i was in Chicago.. well the lawyer did all the works.. i also happen to have a tourist Visa.. and am planning to go back this year for my friends and sister is already there.. I am thinking if there is any possible way i can stay legally while waiting for that petition to be granted?? AOS? am i legible for that??.. or is there any possible that the lawyer is right?.. a 2 year long wait??? for the state of ILLINOIS?????

i badly need some help.. i really need to go back to USA.. and stay LEGALLY..

Have you heard about "premium processing" of I-140 for EB3 visa? It takes only 15 calendar days. :wow:

What did you filed for when you was in Chicago???? :unsure:

EB3 is an immigrant visa. So, once issued, you can travel to US and no need to file AOS because it's an immigrant visa.

B2(tourist visa) is a single entry visa and if you want to come to US again now, you may consider to apply for a B2 visa again at the embassy but then you only got less than 50% of getting the B2 since you already have immigrant petition on file.

These infos are just based on my "basic" understanding. :)

June 29, 2011: Approved original petition left NVC to US Embassy-Manila

July 15, 2011: Eligibility letter received from US Embassy-Manila(dated July 11, 2011)

October 26 - June 5, 2012: SLEC trap!!! (DOT tx to vaccine administration)

June 7, 2012: Interview (APPROVED!) :)

June 18, 2012: Visa picked up at the embassy

June 20, 2012: POE in Detroit
