Does anyone know if you can apply for AOS even before you receive a SSN? We plan to marry a few days after my fiance arrives in the US and submit all the paperwork right after so that he can start working ASAP. We will apply for his SSN 10 days after his arrival, but doubt it will arrive before we want to submit the AOS paperwork. Any advice is appreciated.

Thanks

In order for your fiance to "start working ASAP," he will need to apply for an EAD in addition to AOS. Furthermore, the EAD will not arrive quickly. People who have applied for it in the past can give you an accurate timeframe.

I should have specified that he will apply for EAD along with the AOS

You don't need the SSN to apply for AOS. If all goes smoothly (BIG "if"), the SSN could arrive with a week or two.

The EAD could easily take 2 months to get after submitting the AOS/EAD package. On the other hand, you could get lucky and receive the GC in the same amount of time or possibly even before the EAD. In any event, count on 2-3 months minimum after filing before being able to work.

N-400

Feb. 12, 2016 - Sent N-400 to USCIS (3-year rule)

Feb. 19, 2016 - NOA1

Mar. 14, 2016 - Biometrics

June 2, 2016 - Interview - Recommended for Approval

Thanks for the reply, that's fine, I knew it would take 2-3 months, but didn't want to wait for SSN (which could take up to a month I was told) and then submit the AOS/EAD forms, at least saving some time.

Just confirming. Don't "need" the SSN for AOS. Go ahead and file whenever :)

You can get the SSN within 10 days but be aware sometimes the SSA's make life difficult if they know you're married and try and tell you you're a K3 now and no longer eligible for a SSN (which is total #######). I haven't seen them give men issues but women they seem to a LOT!

Thanks...he is a man, so maybe we will be lucky and hassle free (staying optimistic)
