Is there any way to visit come back and family after in the U.S?

Hello all, I'm sorry if I am posting this at the wrong topic, but it was the only one I could see that was quite similar to what I'm wondering. Ok, here's the question, my fiancé and I are still waiting for our NOA2 (K1 visa), and I know all the process so far until we marry.

This being said I was wondering since I don't think I'll be able to get an interview or even an approval to my parents, for them to be in the U.S for my wedding, if is there any ''waiver'' or however you call it, for me, after getting married, at some point during the rest of the process to visit my family here in Brazil?

My parents wouldn't be able to keep visiting me, and I don't wanna leave them here not being able to see me for several years, so I wonder if is there any way for me to keep visiting, and how would I do it?

Sorry if this was previously replied, but I couldn't find any answer or post similar. Thanks in advance for your help :)

When you apply for AOS post-marriage (I'll assume packet-deal with EAD/AP applications), you will receive the following documents:

  • combined EAD/AP (which can be used for re-entry), valid 1 year
  • 2-year plastic GC (after interview)

Either of these can be used for your planned visit to Brazil. However, you should not leave the US before receiving them.

Why do you think your parents would not get approved? They just need to prove that they have reasons (like house, car, even job) to go back to Brazil, and they will be fine.

My parents had their interview last month, and the got approved with a 10 years tourist visa. The reason they said they wanted the visa was to attend my wedding.

If you want to come back to Brazil to visit your parents before applying for AOS, I think you can apply for Advanced Parole.

When filing for AOS, you should file an advance parole (AP)I-131 (Application for travel document) to be allowed to leave the US and reenter again. Don't leave without this! I heard that it takes up to 3 month till you get it, sometimes faster. You can apply for AP even without filing AOS, it's just cheaper if you do it altogether.

They do have strong ties to Brazil, house, car, their bank accounts, etc. Their age could be a problem? idk, but we will try anyway because I really want them there for my wedding. Don't confuse your ability to get a visa with their ability to get a visa.

As Tacia mentioned, her family was able to get a Tourist Visa prior to them receiving their NOA2. You can ask Tacia what they demonstrated at the interview. I think they may have had a copy of the NOA1 to show evidence of their daughter in the process of Visa to go to US to get married.

Right, I was wondering about their age as an issue. I don't know how they act with old people, but yea.. I'll ask her about that, I think it'd be a good idea though, would show the real intention, since thats what they want. Thanks.

yes you posted in wrong forum.

No problem with you going to visit them.

they should also not have a problem visiting you, just have them submit the forms and they should be fine.

Like someone else said your previous B Visa denial has nothing to do with them. If they have ties at home it should not be an issue.

Everyone has given you good advice so far. My in-laws including 2 sons all got tourist visas and were here for our wedding. They had no issues at all getting approved in Brasilia. I would suggest at least giving it a try for your parents. As for traveling to Brazil, we waited for my husband to get his green card since we were not able to travel so fast after the wedding due to my work schedule. It took about 2 months from the time we filed. Every place is different, but I see on average that it takes 2-3 months for most people. The AP document came for us right before the green card interview, so we didn't end up needing it. About 3 months after receiving the green card, we spent a month in Brasil. There was no problem getting back into the US with the green card. You should be fine as long as you either have AP or the green card in hand when you leave. Good luck with the rest of your process!
