07/17/09 - Biometrics Completed [ Completed in 17 Days ]

08/12/09 - EAD APPROVED! Card Ordered! [Approved in 47 Days]

08/20/09 - Interview notice arrived dated 08/18/09 - Sept 24th/09

08/21/09 - Got EAD Card in the mail!! :D

09/24/09 - Interview Date: 9:00am - APPROVED

10/03/09 -Received GC!!!!!

Total Days from NOA1 to Approval : 86 Days

ROC:

04/01/11 - Preparing for ROC currently

06/27/11 - ROC Mailed!

07/02/11 - NOA1 Arrived [dated 06/30/11]

07/13/11 - Biometrics letter arrived [08/01/11]

10/31/11 - Final Approval!

11/04/11 - Received new card today.

Total Days from NOA1 to Approval: 125 Days

Next Step will be citizenship in June 2012!

Timeline

If you get an RFE, does it appear on your Status? I'm starting to get worried maybe we got one and it was lost in the mail or something. We have had zero updates since Biometrics.

I tried to call USCIS, but even though they say they have operators available, it seems impossible to actually talk to a real person.

Just having a moment of frustration and worry.

Wohoo!

On December 22, 2011, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service at 1-800-375-5283.

Too bad we're leaving the country tomorrow, and won't get the new card in time...

What I was just trying to figure out is why would USCIS post 6 months for I-751 when it seems they know it is longer than 6 months? Why out-right lie about it? Or is it that at the posting time of September 30 it REALLY WAS 6 months?

Looking at their data, it appears the pending numbers just are going through the roof. I wonder too how they will ever catch up.

ok so from what i understood, u have to be a lawful resident, not a conditional resident (which's mean u have to be approved for removing conditions), and been living with ur spouse for full three years and ( he or she) should be US citizen for 3 years. Correct?

I think that it is 36 months from the approval of your lawful (conditional) residence. But someone above state 2 years and 9 months which I am not sure is correct. I may go ask on the n400 forum !

I guess you're the only one who knows about it cuz everybody else is just confused.

Folks 3 years means 2 years 9 months cuz 3 months they give you to apply for to get ready for, its a window in which you could apply like we did when we applied for ROC.

Well I believe that this is where AmberOctober is basing her logic from, indeed for ROC the USCIS website language is pretty clear:

A conditional permanent resident receives a green card valid for 2 years. In order to remain a permanent resident, a conditional permanent resident must file a petition to remove the condition during the 90 days before the card expires. The conditional card cannot be renewed. The conditions must be removed or you will lose your permanent resident status.

However, there is no such language for the N-400. The reason of this for ROC is to allow one to receive the extension prior to being out of status. In the case of N_400, the assumption is that you are already on a 10 year green card and that the time restriction is not really there since you will not get out of status after 3 years...I am still not totally convinced by the 33 months.

AmberOctober - do you have some evidence proving your point?

U have to be approved of removing conditions on ur card in order for u to be eligible for filing N_400, if the case is still in process u cant file for citizenship. I did call a lawyer and asked. Once u get the approval for ROC then u can apply for citizenship . IT is correct that they count from the day u got ur conditional ( 2years and 9 months) but u have to have the conditions removed.

Read the instructions please. Clearly states you may file N-400 90 days before the 3 years of continuous residence status. http://www.uscis.gov.../n-400instr.pdf

Applying for Citizenship

Guys, note - it's NOT 3 months. It is 90 days!

Your clock starts ticking from the day you are issued - yes - the CONDITIONAL Green Card.

From the date of issue of your Conditional Green Card, count three years/anniversaries. You can apply for citizenship in the 90 days preceding this 3rd anniversary.

In USCIS words:

You may file Form N-400 ninety (90) calendar days before you complete your permanent residence requirement if your eligibility for naturalization is based upon being a:

Permanent resident for at least 5 years; or

Permanent resident for at least 3 years if you are married to a US citizen.

USCIS even has a Calculator if counting is too much for you.

You can find this information here.

If you are looking for accurate information about filing, I think the USCIS website is a good place to start from, not the forum. This forum is good for clarifying things or asking for information that is not necessarily on the USCIS website.

No you don't. You can FILE for N-400 while ROC is pending but it won't be adjudicated until ROC is approved. It is recommended that if your N-400 window opens (yes 90 days before you've been an LPR for 3 years, you have to be MARRIED for 3 years at that time as well) and your ROC is still pending, that you file your N-400 as it will force your ROC to be processed.

It says it in the instructions so there IS "such language" and "evidence" proving Ambers point.

You don't HAVE to file for citizenship. There is no deadline. It is just that the window opens at 3 years minus 90 days so you can apply then, or months/years/decades later.

**Edit - it is important to note though that you can file at 3 years minus 90 days if you're still married to a USC. If you're not you need to wait for 5 years (minus 90 days).

Kinito_2k3, just download the N400 form and read its instructions, they answer pretty much all the questions you might have.

90 days, not 3 months like I said, sorry. It's just I know for myself that I'm going to apply some time after the window opens, so didn't bother calculating the date precisely :)
