I am a USC,i met a lady who is on F-1 visa and we fell in love. we started living together for two months before we decided to get married. But the moment we got married, she started misbehaving. she started calling one guy in UK and telling him how much she loved him and she cant wait as soon as she got her GC to come and be with him. i was so furious and mad when i discovered the secret affairs between them.Instead for this lady to apologize and stop the secret affairs, she started cursing me and telling people i dont want her to talk to her old friend. i was so depressed and could not do any thing. Because of my insistency, she started beating me up. she beat me several times that at one point i have to call police on her, after i dislocate my shoulder and my face was full of blood. she was arrested and charged for second degree assults.

soon, the letter for the interview came, i saw it and i hid it from her. after the interview date has passed, USCIS wrote us [both us separately]. she was told to leave USA within 30 days. i was told reasons why her i-485, was denied and options left for both of us. because of the love i had for her i went to court with her and she got probation before the judgement for one year. there after we got another lawyer and reopen the case.

after this letter, she was alittle bit sober and reduce the number of time she talk to the UK guy.But she never felt remosed for her actions. she kept cursing and threatened me to retaliate. i later over heard her telling one of her friend " she is going to set me up". that day i moved away from to another state. on the day of second interview i didnt show up. later i received later form USCIS that all our application had been stop and no further action.after that she told my friend, she has been sent a court letter to appear.

my question now is;

1.what is going to happen to her at that court?

2.is there any thing i can do to save her from deportation as my wife?

3.can she still get the GC,can i file an appeal letter to USCIS?

Are you referring to a court letter to appear for the 2nd degree assault charges?

From your letter and the way I am reading it, Why are you wanting to save her from deportation? She said and I quote, "she is going to set me up". There are many stories of women claiming abuse to get their green card and you will go to jail for Criminal Domestic Violence. (also there are many men who abuse women) Which happens to be a big deal lately in the States with all the advocate programs out there.

Anyhow, sounds like you are being taken for a ride. Wake up and smell the coffee. She beat you and was guilty but given probation, She continues to talk to this guy even though you say less, which means she is probably hiding it better. You have fled the relationship. Sounds like you are headed to a divorce. What is it exactly that you are trying to save?

1. They will probably deport her, I hope so.

I am sorry for the pain and abuse you have had to endure emotionally and physically from this woman. Yet, you still want to save her from going back? I am sorry that doesn't make sense, specially when she is contemplating further actions against you, or even harm you?

Take time to reconsider your options carefully, and seek professional help, such as therapy to sort things out for yourself. Think about yourself and where you want to be in the long run. Where she is concerned, I suggest you wash your hands of this woman, and let her UK man file for her and have her join him in UK.

Your concerns should be about your safety, your well being and happiness from here on. Take care and good luck! :thumbs:

the letter sent to her is for her to appear in court for the deportation. we have gone to court for the assult, that was where she given probation before the judgement.

you are right...she has taking me for a ride for too long. and she never care anything about me or our relationship. i knew all these long time ago, when she started beating me. she will be telling me not to mention the guy's name again because she loved him more than me.

the reason i want to see if i can still save her from being deported is because of the love i heard for her in the past. i am filing divorce soon. but i just want to her to remain in this country, if possible.

If you save her from deportation and she gets a green card, she will be on the first plane to UK...is that what you want??

If you really want to have to possible pay back the government for any means tested benefits they might provide to this woman for the next 5 years to infinity you are on the right track.

Her AOS was stopped and the only ways for her to obtain a green card now would be for you to commit immigration fraud and pretend the marriage is all hunky-dory or for her to claim you abused her and she can file under the Violence Against Women Act. The second is probably what she means by setting you up. All of this is dependent on whether her violence charge would mean an automatic deportation.

Stay away from her, let her be deported, and good riddance to her. It is usually the nice guys who end up in last place.

try reading your own posts and think about what you would tell the individual if you were reading these posts. No one here wants to sound judgmental by telling you what you should do, it just seems to be a very bad case of being used. AYMAN_RINA made a nice post that should be a wake up call for you. You are running the risk of going to jail for CDV not to mention the fraud you would be committing to keep her from being deported. Keep in mind also the tremendous financial burden that would fall on you should she stay and become a public charge after leaving you once she gets her green card. Then you will not be able to afford a future relationship.

It appears that you have been used and abused. People like her is why the rest of us have such a long wait and hard time getting approved. She is the master of her own fate, let her go figure all of that out. Good Luck and be careful.....

lmaooo. the guy is in love...I see things like this alot on Investigation Channel...Be careful,you might end up 6 feet under..Sometime the bset way to help someone is from a distance and letting them solve their own mess..You are not her parent,after all she did,you have no obligation to help her...Forget love,you might be in lust not love...
