HI GUYS I REALLY NEED SOME HELP REGARDING MY CASE, IM PLANNING TO APPLY FOR CITIZENSHIP DUE TO NOBODY KNOWS HOW LONG THE RETROGRESSION IS, CAUSE I HAVE A PENDING PETITION TO GET MY WIFE AND MY DAUGHTER, MY FRIEND ADVICE ME TO BE A US CITIZEN IN ORDER FOR ME TO GET MY FAMILY FASTER. I REALLY WANT YOUR OPINIONS FOR ME TO KNOW IF IM ELIGIBLE TO BE A US CITIZEN..

HERE IS MY CASE;

Got my GC 6/28/03

-went back to my country 9/16/03

back in US 6/6/04 (out for 265 days)9 MONTHS

-traveled 9/13/04

back in US 5/20/06 (out w/ reentry permit for 615 days) 20 MONTHS

-traveled 12/12/06 IM UNDER MY DAD INCOME TAX AS A DEPENDENT CAUSE IM A FULL STUDENT IN MY COUNTRY.

back in US 6/2/07 (358 days) ALMOST 12 MONTHS :)

-Traveled 5/11/08

back in US 9/6/08 (104 days) 4 MONTHS

-Traveled 11/9/09

Back in US 12/6/09 (28 days) 1 MONTH

-traveled 12/31/10

back in US 1/30/11 (31 days) 1 MONTH

I KNOW MY 5 YEARS IS FROM 6/2006.. I'VE BEEN OUT FOR 358 DAYS 8 DAYS SHORT TO BE A YEAR OUT.. I DONT OWN A HOUSE OR RENT SO I DONT HAVE ANY THING TO SHOW, I ONLY GOT MY DADS TAX RETURN THAT I'M A DEPENDENT.. IM REALLY ANXIOUS 680 IS NOT A JOKE.. PLEASE HELP ME, REALLY APPRECIATE IT... THANK YOU IN ADVANCE...

How did you get your green card in the first place? and your residency time has been reset back to 0 several times for what I can see. You will have to disclose all these trips on N-400 form.

yup.. I include all my trips in the form, My uncle petition my dad, got my green card thru it.. Just want to make sure I'm a bit worried that they will gonna deny me due to a trip on 6/06-6/07..

If in the last five years, you have been outside the US for less than 30 months total, then you are eligible. See the worksheet: http://www.uscis.gov/files/article/attachments.pdf

Yes, I've been outside less 30 months.. but my worries is for the continous residence here.. I went to the Philippines for 6 months but less a year in 06-07.. I'm just confused in that category..

When filing for naturalization, the immigration officer has a lot of discretion. The standard put on someone who wants to be the equal of a natural-born US citizen (that's what naturalization means) is so much higher than that of a foreigner allowed to reside in the US as long as he obeys the rules of the game.

Good moral character counts, as does any behavior in regard to residing in the US as their country of residence, or the lack thereof. Yes, after your residency clock stopped several times and reset itself to zero once, you have somehow managed to stay in the US a bit half over the time you should have resided here. So formally you meet the continuous residency requirements, but that's not the whole story. I would not be surprised if the I.O. would ask you a lot of really unpleasant questions, then have you bent over and leaves the room to get that proverbial 10-foot pole from the garage, figuratively speaking, of course.

Your case is one that begs to be denied, simply because, and you need to be prepared to present yourself as a clean-cut, upstanding young man who wants nothing more than becoming a US citizen because he loves this country so much. If you can pull this off, you have a chance, but if you come over as someone who only visited the US long enough to barely escape being kicked out of here, and that for almost 8 years now, you'll have to fear the worst.

There is no room in this country for hyphenated Americanism. When I refer to hyphenated Americans, I do not refer to naturalized Americans. Some of the very best Americans I have ever known were naturalized Americans, Americans born abroad. But a hyphenated American is not an American at all . . . . As far as my concerned .. The bottom line here is about your travel time outside United States.. When I read your Statement starting from 2006 you've been gone four consecutive times.till 2010.otherwise You didn't comply your 5 year rule residency before prior to apply for citizenship.

Only if you meet the requirements, such as doing religious work for a US based organization while you were overseas.

I red an article that state i can only use 4 yr 1 day rule if my absence is more than a year. so i can only apply 4 yr 1 day rule if Im out for more than a year?

Also for the absence 6 mos less 1year, Im just curious if I understand it correctly, I was a fulltime student in PH, did not apply for any job in my native country, my immediate family stayed here, and also in 06-07 I was in my dads income tax return as his dependent. Are they gonna consider this if I have evidence?
