CASE SENT BACK TO USCIS FROM NVC

I personally would not contact a visa specialist, they will only charge you vast amounts of money to tell you what you will find out in the end....Did you make copies of what you sent?

Here is the number if you ever need to call Visa Specialist and not pay a dime.(Unless you're not in the US or don't have unlimited Nationwide Long Distance) This number is in Washington DC 202-663-1225. As soon as you get the recording dial 1 and then dial 0.

You are not the only one that this has happened to. I went through the same thing last month, and I can only tell you what I found out through my local Congressional office. USCIS Vermont made a lot of mistakes in the Visas that were approved recently. They did not tell me excactly what happened, but it was no fault of my own. The sad thing is that it is looking like I am going to have to wait another five months to find out if it will be approved the second time. It seems that most of the cases that were sent back were simply cases. No red flags or anything. I have no idea what is going on at the center. This is just for my case, but there are to many people posting the exact same thing for this all to be a few isolated cases.

If anyone has any information or ideas on how to get USCIS to start fixing these cases please share them. I was told that that the date they receive it back is the date they file it ie. you start the wait all over again. I have talked to several attorneys and they say there is nothing you do but wait.

Timeline

Usually a case is sent back to USCIS if there is a mistake on the form or if it was not abjudicated properly. When our lawyer did the paperwork his assistant did not answer the question regarding the criminal record as it was right next to the military record one. She assumed it was the same thing even though i yelled and screamed at them to fix it they never did. After 6 months of not hearing anything from USCIS we called our congressman within a week we had our NOA2, HOWEVER after being at NVC for a week, they saw the error, and that USCIS did not abjudicate it properly so they sent it back to be rechecked. We also had a long delay with the petitioner checks with teh FBI for criminal records as well.

But usually if NVC sends it back its due to an error and that NVC thinks it was not abjudicated properly. Unfortuneately this caused me a very long delay, Total time from I129f application to interview: 377 days. with 3 congressman involved and a hell of a lot of yelling scremaing and phone calls. Make sure you get your congressman involved asap.

It took a month for the file to get back to uscis and then another month for an RFE to show up. Bascially i lost 3 months before it was reaffirmed. That put a huge strain our relationship. We almost didn't make it. And i'm still ticked off at that mistake...needless to say the lawery was fired so fast her head must have spun.

Timeline

There have been a rash of returned cases. I think there is a new internal form that NVC requires that the offices keep forgetting to include. You probably won't hear anything. It will go back and they will fix things and send it back.

This will not be over quickly. You will not enjoy this.
