CASE SENT BACK TO USCIS FROM NVC

I called NVC on 5/20 and they told me that the case was sent back to uscis to call them directly, since I was away I called today and Uscis tells me that case was approved and they haven't received anything from NVC, I called NVC back and they told me they sentthe case on 5/25 to uscis because they're the ones who requested it back and till give them 2 weeks to see if case was in their system and find out why it was sent back because NVC couldn't give me a reaso..Don't know what to do!!!

Are there any red flags in your case? Usually, NVC only sends back the case if they notice something USCIS should have noticed, such as one of you was not free to marry at the time the petition was sent, or maybe an IMBRA issue?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

There are no red flags, neither of us been married or kids.. What's funny is that when I call uscis the rep asked me if I was filling out an I-30 form, I told him no that it was 129F, he then put me on hold..ughhhh

what??? that is crazy why would they do such a thing?? Definitely get your senators involved and keep calling NVC, USCIS, and even visa specialist to see if maybe they got the wrong information. Best of Luck!

Why are everyone freaking out why would they do that? the NVC doesn't usually send case back to USCIS, something fishy came up on the case and NVC send it back to be re-adjudicated, maybe the OP needs to find out if his/her fiance had any previous application filed on his/her behalf or an arrest.

NVC sent it back for a reason, just find out what was the reason before proceeding with Senator or Congressman.

Timeline

I always thought that on K1 all NVC does is background check on the petitioner. Basically, I am not even sure they do that.. The only thing that could come up is:

1) Petitioner not free to marry

2) Name had a criminal hit or something.

How long was it at NVC?

I personally would not contact a visa specialist, they will only charge you vast amounts of money to tell you what you will find out in the end....Did you make copies of what you sent?

It was at Nvc a little over a week..Yes I made copies of what I sent..I've never Been married or petioned for anyone before..They don't charge you to call a visa specialist@Nvc!

The only thing that I can think of is that they had a hit on your or your fiancee name in the criminal history and confirmed it. You may think of any criminal history? Have you ever been arrested for anything? DUI? I have a feeling that the only thing they check at the NVC stage is criminal history of the petitioner.

I'm thinking there must be some kind of error here if anything! Maybe they mixed up your file with somebody else's case! This kind of thing did recently happen to another friend of mine, but it did get corrected with consistent inquiry by the Petitioner in writing. OH yeah, one more thing! She did include Congressman or Senator (I can't remember which now) but it seems it got resolved before they had their hand in it. Go figure.
