hello everyone. Here is the issue my fiancee recieved his letter from the embassy on may 11th. However due to the fact that I was unemployed for awhile I have not sent out the documents he needs to schedule his medical and interview. It's been stressful as I live with my mother and younger sister. My mother agreed to be my Co sponser with the condition that I am working. The good news is I recently got a full-time job as an Admissions and placement officer at a small nursing school(this past week). I am hoping to get all the documents to him by the end of this week with at least one paystub. My question is will the delay in documents cause the Embassy to delay our Approved K-1 visa? Should I contact them to let them know why he has not come forward with all his documents? Any info would be greatly appreciated.

The NOA2 should be valid for 4 months. If that is not enough time, you can contact the embassy and see about an extension.

Ok, some clarification please. You say delay your approved K1 Visa, or did you mean delay the approval of your K1 Visa? It sounds like all you have is your approval of the I-129F application which then allows the beneficiary to apply for a K1. Which is then approved or denied at the interview at the consulate.

Some of the requirements needed for approval is absolutely the Medical and absolutely the affidavit of support. Without this you definitely can not be approved as you have not met the conditions and requirements set forth for the approval of a K1. Maybe you can be more specific with your post. That way you others can try and be a little more helpful with some responses for you.

However, you still have some time to get all of this done as your NOA2 has not expired yet.

So what documents are you referring to about the medical? Typically speaking, the only documents needed from the petitioner is the affidavit of support I-134 with last years federal income tax return (each consulate may have a different specific requirement regarding the I-134). All of the other documents required...DS-230, DS-156, DS-156K, DS-157, Sworn Statement, Medical exam etc..... are now provided by the beneficiary who is now applying for the K1. The letter he received should outline any specific requirements.

Do you already have an interview date? Or do you have to send in the documents then it is made? You have no information regarding where you are filing, so can not really point out any nuances for your beneficiary's consulate. For example, we knew our interview date 2 weeks before receiving the letter from the consulate. And in Brazil, packet 3 no longer exists. You get a web link and follow the instructions and show up at your interview date with everything in hand.

Seeing how you just got a job this past week, they may question extensively your ability to support. Not saying they will, but saying it is possible. It may be best for you to still get your mother to co-sponsor if she is agreeing. Maybe a more senior member will add their experience into this thread. Please keep in mind some consulates do not allow co-sponsors. I am sure you have already researched that and know the answer though.

However, if your interview is not scheduled, then you are ok to round up your affidavit of support and send it to him ASAP. As it has already been mentioned, your NOA2 has not expired.

Just another note of interest, maybe you should go to portal link from home page of VJ, then select the country your fiance is in, then once there, look at the consulate information and reviews. Also, if you fill in your profile with more information, then your post would have appeared on your portal page and other members who have beneficiaries from that country (who have dealt with that system) would be able to help you also. Like I pointed out, there are many differences between countries on how they handle the interview stage.
