Hi everyone!

My CR1/2 visa is under administrative review at NVC as of yesterday. Should I file for K3 now since I don't know when the A/R is going to be over, and maybe the K3 will do better. Any ideas will be appreciated

Well, it is hard to give any yes or no answer. Hope your administrative review does not take that long. I noticed that your NVC process is taking more than 4 months. Had you followed the shortcut methods, you could have saved few weeks. Even if you apply for I-129 F, it may take at least two months for the approval.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

Yes it may take 2 month but the A/R may take more... a lot more....

Are you sure they run the same checks for K3 before the file gets to the embassy? also, don't forget that there may not have been a name hit, sometimes they assign administrative review at random (At least that's what the NVC operator told me)

Thanks for all the help guys,I hope it will get resolved soon. The waiting and not knowing has been really hard on us

Yes, the AR may take more than 2 months or less than 2 months. It is hard to say. So it is upto you whether you will apply for K-3 now. If your AR finishes very soon, then your I-129F will be of no use.

There was a post by 'the Visa Partner' that suggested that those going through China were being scrutinised at present due to some situation with China. How correct this information is I dont know. 'The Visa Partner' is a former NVC employee and was apparently told such by a current employee of NVC. The post about it however is no longer available.

donnaal is correct in that AR can happen with the K-3 petition as well. Background/security checks are conducted at all stages of this process.

Name/Security checks are a normal process with NVC/consulates but the wait time at NVC is generally not too long as cases may be forwarded to the consulate prior to the name/security checks being cleared. Administrative processing usually refers to a legally mandated security check the Department of State (NVC) must do for all applicants/beneficiaries over the age of 16. The length of time one can be held up in administrative processing will vary as some countries are subject to closer scrutiny. The process normally takes four to six weeks but as I said it can be much longer. Full fingerprints are sometimes required at consulate level but this is all a part of the initial administrative processing that began at NVC. Once an interview is held a visa will not be issued until/unless clearance has been received. In most cases (again dependent of country), administrative processing will be completed and clearance granted well before an interview is even held.

There is nothing stopping you from filing the I-129F for spouse to the NBC. The most you will lose is filing fee/postage etc. and you will be covering your bases just in case.

k-3 will be cancelled should you attempt to file.

because your I-130 was already approved. because, the k-3 is to allow your spouse

to join you while waiting i-130 approval . since you got approval its usless. now if luck had it- if the k-3 made it to the embassy and you got interviewed- you would still be on AP/AR.
