Guam trip after marriage/before AOS from F1

Hi All. We've read through the great posts here and have seen the great advice so I hope you can help us as well.

He is from England and have been in the US on a student visa for over a year. I am a US citizen. We were married in California last week and had planned to go to Guam on vacation in June. We thought he could return on the student visa but have now read otherwise. He has not filed for an adjustment of status yet. Is there anyway for him to still go to Guam and return? I wasn't sure about Guam because it's a US territory.

I would say apply for advanced parole (AP), however, that takes a long time to be issued. Furthermore, I don't know if you have to apply for AOS first before being able to apply for AP.

Thanks Ryan. From what I read it appears that he would have to apply for AOS first before the AP and we already have the trip booked for June. So I'm thinking he will not be able to go.

Marriage alone doesn't change his status so he can return on F1 visa. His status will change when he files AOS and won't be free to travel until he receives AP or GC.

Thanks for the reply. He wasn't going to apply for the AOS until after we got back because we knew he couldn't re-enter the US while it was pending. However doesn't the student visa entry mean he does not intend to immigrant here?

I'd say at this point in time he is just a married international student. He has not made any attempt to be an immigrant yet.
