A distant cousin of my wife unwittingly filed a K-1 application without having met his fiancée within two years. It's been at least three since visiting, and he wasn't aware that this was the fundamental basis of the K-1.

In any case, he clearly cannot meet the stipulations of the RFE: provide evidence from that two year period prior to the submission (which they do not have), or meet the requirements of the hardship waiver, which clearly cannot be substantiated.

Would the best course of action be to withdraw the K-1, visit, and then submit a new one???

The RFE clearly asks for evidence from the previous time period, and I'm left to assume visiting now won't factor in to the current application.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Withdrawing the petition is OK but he'll soon get a denial notice that serves the same purpose. Yes, go meet and then re-apply. Surely taking photos would be something anybody would do but focus on actual primary evidence of the meeting. It's explained in his RFE but passport stamps and boarding passes are usually the best evidence of meeting. Photos are good secondary evidence of meeting and do provide some evidence of a genuine relationship.

Facts are cheap...knowing how to use them is precious...
