Can I apply for a Student visa?

You are 19, you do not have the basic educational requirements somebody looking for further education would be expected to have. And you are incurring significant cost and expense in wanting to do it in the US.

They I am sure would be wondering what the real reason behind your application is.

Then add on a blotted immigration history to make matters worse.

But you can only try.

Its actually cheaper for my to go to community college to do my AS degree in nutrition than it is to go to university here.

I have the basic key skills I am required to have here, but the school I am wanting to apply for just dont know what they are, so need evaluating.

I made a lot of mistakes when it came to my education, I was a typical teenager thinking I know best. I am doin everything I can to get the best I can. I have the diploma in the field I am wanting to be in.

Apart from loving California I think it would be a great place to get the experiance of exercise and nutrition. It would be an attractive point for future clients that I have experiance from California.

Keep in mind that in order for a college to accept you as a student, you will have to take certain tests prior to being admitted. ACT, SAT, etc... whatever the college prefers (applies to all students, not just foreigners). You WILL have to demonstrate a proficiency in English, as well as other basic subjects. No way around this. The first step in the Student VIsa is being accepted into an educational system that is approved by DHS.

Once you have that, then you can proceed with applying and then you will have to meet further requirements. Some of these including....

Have a residence abroad, with no immediate intention of abandoning that residence;

Intend to depart from the United States upon completion of the course of study; and

Possess sufficient funds to pursue the proposed course of study.

Furthermore, at the interview, you should be prepared to provide the following..

Transcripts and diplomas from previous institutions attended;

Scores from standardized tests required by the educational institution such as the TOEFL, SAT, GRE, GMAT, etc.;

Financial evidence that shows you or your parents who are sponsoring you has sufficient funds to cover your tuition and living expenses during the period of your intended study. For example, if you or your sponsor is a salaried employee, please bring income tax documents and original bank books and/or statements. If you or your sponsor owns a business, please bring business registration, licenses, etc., and tax documents, as well as original bank books and/or statements.

So, there are the basic requirements........

I am English so the school said there are not any test required.

I dont have my own residence, im 19. I live with my parents.

My family is planning on putting together a lump sum in my bank account required for the first year and then providing proof they can sponser me for the rest.

I also have a family friend that I would be able to live with.

Therefore I wont have rent, just general living expenses, food etc. how much would I need for that?

By family friend, you mean your fiance? After all, isn't that why you want to come over here?

Hey, me and my fiance are having a hard time finding a way to be together.. I am from England and he is from California.

OK, it looks like to me you two want to be together. Why doesn't he file K1 Visa for you? His dad can co-sponsor him, assuming he is willing and able. Unless you have already taken the tests necessary for school and have your application already submitted, the chances of getting in this fall are low. In addition, most colleges and universities have a deadline for admissions for each fall and those have already past.

Is this a DHS approved college/university you are applying to?

It may be quicker for you guys to try the K1 and then you don't have to worry about money issues to come up with for school. It seems like to me you are fishing for all the different ways to be together. There is no quick and easy way to do it. Everyone has to jump through the same hoops to be together.

Have your fiance talk to his dad openly and honestly and see if his dad is willing or not.

When you talked to the school, they should have told you if you told them you were an international student. Call them or email them, but that seems a little irrelevant right now.

Applying by this November is for School year 2012, not 2011. 2011 classes start Late August to Early September. That is fall semester here in the US.

If your fiance does not meet the the poverty guidelines, then he will need a co-sponsor. They do not combine incomes. So the dad will have to meet the requirements for the dad's household plus you.

There are links on my signature and I suggest that you and your fiance read them thoroughly. You will find that you will get far better answers when asking about specifics instead of general requirements that you can read. After all, it is the responsibility of the petitioner to be self-informed about the process.

Something to add: The Consulate might deny the student visa if they think your grades aren't good enough.

I don't know about the US embassy where you are, but the one in Malaysia has denied student visas before on the grounds of bad grades. Even though those students were accepted by a US college.

It is not cheap for an international student to go to school in Calfornia. There is one rate for residents and another for non residents. The non resident fees are a little over 6000 for nine months the resident fees are about 1000.

This will not be over quickly. You will not enjoy this.

For those not familiar I doubt if those qualification would add up to a High School Diploma.

I am in contact with the school. I am fully aware of the cost for the course I am looking at.

Sorry, but I disagree with this. You have made conflicting statements about emailing the school. Talking to the school. Waiting for them to get back in touch with you. If you had talked to them, you would know if they were DHS approved or not. If you had talked to them, you would know the requirements for admission and answered my questions about what tests you had taking (GRE, ACT.. etc....)

If you have been in contact with them you would not be asking questions like this one.

I want to apply for a student visa, I have a school sorted but worried I wouldnt be able to apply because I just left and I had overstayed. I was hopeing to apply to start school in August but dont know if this is too early to try and would starting in January would give me better chances?

Also is it possible to apply and be accepted within this time (june - August)?

Your inability to either get your facts straight or keep up with what you have already said looks extremely suspicious.

The bottom line is that you are not going to meet the requirements for admission into a DHS approved institution here in the US.

Your grades are not good enough. At best, your grades may get you into a vocational school. I haven't seen many of those approved by the DHS. You have not taken any exam for admission into college. I don't care if you are from Montana or China or India, much less the UK.... You MUST take these exams. By the way, India kicks our butt with the math SAT scores. The fact that you have no idea about what I have already expressed to you in terms of college admission proves that you have NOT looked into it sufficiently. You are fishing for a way to get over here and be with your BF. Plain and Simple.

This is exactly why the laws are stringent to catch little things like this. As I previously have posted. Just go for the K1 Visa. But it sounds like there is a little problem of money. You have already been "stranded here because you missed a flight and had to wait for your BF to work and make the money for the ticket back home". Which subsequently caused you to overstay.

You have a lot of obstacles to overcome. You also said your BF was coming over there to finish school? Maybe that is a much better plan.

There is no SIMPLE way to get through this and USCIS is trained to spot such ill advised attempts as yours should you even get to the point where you are able to apply for a student visa.

If you want to be with your BF. Then he needs to get a job that can support him and you, file for either K1 or IR1/CR1 (should you want to get married before then) and come over here legally. Marriage is a huge HUGE responsibility.

This is not taking a car out for a test drive and see if I like it scenario. There are long term requirements for bringing a foreign spouse or fiance to the US for good reasons.

Keep in mind that if you are denied by the USCIS because of reasons thought to be a fraudulent attempt to gain entry into the country, that you may be banned from entering the US... Possibly forever.

Think very carefully before you say or do anything else that may or may not incriminate you further.

If the qualification OP has does not added up to high school diploma, then how is any Univ going to accept her?

If no Univ accepts her then there is no interview with consulate for student visa simple.
