I have a question, one of my friend keep on insisting that we can apply EAD without filling the AOS, is this true?

Read the instructions on the EAD form. It clearly states that you need evidence of filing for AOS. Your friend is dreaming.

Feb 2005 - APPROVED for K1 Visa

June - 2005 - Moved to the USA =)

Apr - 2006 - APPROVED AOS Without Interview!!

Feb - 2008 - REMOVAL of conditions!!!!!

02/20/2008 - Package was sent to TSC.

02/25/2008 - Package confirmed received at TSC.

Actually, you can apply for EAD based on K1 status. It expires when your K1 does, and takes as long to process as a regular EAD. That means that by the time you get it, you have about a week and a half to use it in most cases.

Most people consider it not worth the bother - or the money ;)

If you fly in through JFK, you can get the EAD stamp in your passport. That also expires at the end of the 90 day K1 period.

Your friend is not dreaming as someone says. I applied for EAD without applying for AOS myself.

That is a choice you only can make.

I am now a US citizen.

Oh by the way i have a questions to you internetfake, you said you applied already your EAD without AOS, my questions are:

1. Is your EAD approve?

2. When you applied the EAD is your I-94 still valid or not expired?

How you figure? did you get approved? Did you apply on a k1 visa? Do tell us. I'd like to hear about this.

I understand that only those with K-3s can apply for EAD without AOS (if they are processing CR-1/IR-1 visas in their home country consulates). For K1, you need to file EAD with or after filing for AOS.

09-02-2005 Applications for AOS, EAD, and AP received by MSC

10-21-2005 AOS fingerprint notice for 12-08-2005

11-07-2005 AP approved

12-05-2005 Infopass appt at San Jose office for interim EAD -- Refused, because it is already approved by MSC on 11-07-2005

12-07-2005 Attempt at interim EAD at San Francisco office -- no go. Back to San Jose, where CSO (chief station officer) tells they will contact MSC via email to request permission to issue interim EAD

12-08-2005 Biometrics for AOS and EAD. Having no EAD appt letter was no problem (used EAD NOA)

12-15-2005 EAD arrived in the mail

12-24-2005 Received interview letter; interview scheduled 03-01-2006

01-28-2006 Received replacement SSN card in married name (5 wks since application)

03-01-2006 AOS interview -- approved; received stamp in the passport

03-13-2006 Green card arrived in the mail

That's not true, kc. K1 is entitled to EAD. Just for the reasons I outlined above, most people don't bother unless they can get the stamp from JFK.

Also, if you get K1 work authorisation, you have to stop working when your I-94 expires until you receive your AOS-pending c(9) EAD.

Make sure you're wearing clean knickers. You never know when you'll be run over by a bus.

I am sorry to soar your hopes 'MYLOVE'

I did not notice the fact that you were asking about K1. Although I came here first on a K1 visa I had to get K3 because I had to return to my home country before adjustment.

Therefore I applied for EAD without AOS based on K3 status.

Again I am sorry to soar your hopes.

However as you know both K1 and K3 petitioners use the form I 129F, the same form. a(6)

You have to get married within 90 days of entry and apply for AOS.

I am now a US citizen.
