1-130 rejected because of mistake on 1-485

Hi Myopia, thanks for your reply. Actually, I did not send my application back yet, because I had meetings with 2 lawyers and their optimism seemed to be variable. The least optimistic one became a little more positive after seeing the USCIS response to the lawyer association, dated April 7, 2011, that you posted a while ago (THANKS FOR THAT TOO). So I am assuming that he is not perfectly up-to-date. Furthermore one of them strongly suggested to submit the application with the medical at this point so I am waiting for the results of the tests.

As for the notice of actions forms, lawyer said to submit them as well (it wont hurt, he said). I will post the corrections of my application after I resubmit, so that people can benefit from my mistake.

Just to let everybody know that we got our approval today. We are so relieved... especially after having submitted our application after my VWP expired.

The officer was nice, but she did not decide immediately. She said she needed some extra time and she prepared us to wait up to a week; but in the afternoon we checked the status of our application online and it changed in "card production ordered". My husband woke me up screaming!

Thanks YOU ALL, for all your support, suggestions and encouragement.

This community is priceless.

OMG congratulationsssss!! Did she ask you about your overstay or intent to stay or whatever? Because I'm kind of in the same boat and i have a 3 year overstay....

10/07/11 Checks cashed 1490$ from personal bank account

10/10/11 Received NOA's for i-130, i-765 and i-485

10/15/11 Biometrics appt received dated for 11/04/11

11/04/11 Biometrics successful!! took about 10 mins

12/01/11 EAD Approved!!! (in 58 days)

12/08/11 EAD received.

12/12/11 Applied for a Social Security card/number.

12/16/11 Received a Social security card/number.

12/22/11 Interview notice received for Jan 23 2012.

01/23/12 Interview in Atlanta..APPROVED on the spot!

02/02/12 Green card received in the mail! DONE! :D

OMG congratulationsssss!! Did she ask you about your overstay or intent to stay or whatever? Because I'm kind of in the same boat and i have a 3 year overstay....

The overstay did not even come out. She was mostly interested in evidence of our life together and our relationship (such as lease and joint insurance/bank accounts). However, keep in mind that my overstay was only a few weeks, and when they sent me the wrong forms back (at which point I was already out of status), they included a yellow page saying "PUT THIS PAGE ON TOP OF YOUR APPLICATION TO RECEIVE SPECIAL ATTENTION" to include in my next application. So they might not have considered mine a voluntary overstay. I honestly don't know.
