need an ideas:) (Prev. K-1 withdrawn, new petition & petitioner)

hi everyone:) just asking some ideas and if anyone had the same experienced like me...july 2008 i was petitioned as k1 and got my noa2 november 2008, by mid january of 2009 me and my ex decided to cancelled the petition and he called the nvc. at the end of january 2009 i recieved a letter from my embassy stating that i can schedule my interview. so i decided to go to the interview because i don't want to have a bad record to the embassy. the consul told me that according to their system that the petition was cancelled and asked me if i knew about it and i said yes but i was wondering why they still sent me an interview packet, so i got 221g waiver. so they took my passport and some of my documents and told me that incase my ex wants to continue the petition he'll just call and they will give me another interview. but before that interview me and my ex was not in good terms already and before my interview he just dissappear and never heard from him anymore. so within time i went busy and no time to get my passport to the embassy. but after like 6 months i decided to go back to the embassy and get my passport. and before i got it they asked me if i'm sure to get my passport and i said yes and they told me that they will forward the cancelled petition to the national visa center...and now my fiance filed a k1 petition last month and we got our noa1 march 16th..my question is is there anyone had the same situation like me before? i know they will question me on my interview about my previous petition:( is my new case will be affected?..just getting confused now any ideas will appreciate:)

Did I get this correct, you are the beneficiary and the petitioner that just filed for you is not the same one that filed for you before?

In any case the beneficiary is not affected by prior filings for them.

Did I get this correct, you are the beneficiary and the petitioner that just filed for you is not the same one that filed for you before?

In any case the beneficiary is not affected by prior filings for them.

Well then it seems there's no problem. There's only one interview for you to deal with now and thats for your new man! Good luck!

I honestly don't know if you'll be okay. They could accuse you of attempting visa fraud with the first K1 and trying to get the visa even though the petition was cancelled... but they might also just ignore it but you won't know until the time comes.

I keep reading about these, but I am still not used to such "quickie engagements" or deciding to uproot and spend your life with someone else in another country in a matter of weeks prior to actually meeting them... Have you met Darren? Perhaps your fiance is related.

But it's not me you have to worry about, it is the CO. I'd agree with Vanessa&Tony, could be a 50/50 chance of it being a problem. Best of luck.

i read darren's story but i don't see anything wrong with that and besides love doesn't need to count times on how long you've been together it's all about how you love and trust each other. i've known my fiance now for 7 months and everyday we talk and see each other on skype because it's a long distance relationship and he's working so as much as he wanted to stay with me he can't because he needs to work...if you don't have a good advice just leave my page..anyway thanks for reading... :bonk:

Well I had little bit issue with the other posters saying you could have a problem cause they are making assumptions about why the previous guy withdrew. Since you still got the packet from the embassy you had to act upon it just in case the past guy changed his mind.

Yes you could get questioned about it in the interview, if somehow somebody remembered you but if you have a good explanation then so what. But what would make sense is they keep track of K-1 cases not individuals. Since this is a completely different case then the one with the previous petitioner they should have no right to judge you, and their only right should be to judge the case at hand which the current petitioner brought up.

Well I had little bit issue with the other posters saying you could have a problem cause they are making assumptions about why the previous guy withdrew. Since you still got the packet from the embassy you had to act upon it just in case the past guy changed his mind.

But what would make sense is they keep track of K-1 cases not individuals. Since this is a completely different case then the one with the previous petitioner they should have no right to judge you, and their only right should be to judge the case at hand which the current petitioner brought up.

when i went to my interview i was asked why we cancelled and i explained to them why we didn't hear from them after we canceld it and when it's time to get my passport they asked me if i'm sure to get my passport and cancel it and i said yes:) i'm also sure that i will be question about my previous petition. i'm glad that you are sharing your ideas and i really appreciate it:)

That exactly was my impression when I read the subject. You may be in love, I don't know, you have to take a look at this issue as an immigration officer would.

One person filed for you, then it was cancelled and short after that a second person files the application. That just doesn't sound right.

Either way, let us know how you did.

my first petition was 2008..was that still short after 3 years? i really appreciate your idea:)

thanks tahoma:) i've been thinking about having my fiance on my interview but the thing is he can't easily get a vacation leave because of his work:( but i'm still hoping he'll be there on my interview:) i saw you're from seattle. and my fiance is from there too:)

I have seen a lot of posts where people from Philippines gets denied at their interview because of this. One day they are applying for a K1 visa with one person and in the next few months they are applying for the same visa with someone else. And its not like every single filer of a K-1 visa is a member of this site.. So if we see a lot of cases (on visajourney) like this one getting denied ...u can guess how many the consul sees everyday!!

I aggre with Peter_ "you have to take a look at this issue as an immigration officer would"..

Just try to colect as much evidence as u can...and good luck!!

02-13-2012- Email saying case was transferred to another office(Waiting for the hard copy to see where it was sent)

03-13-2012- Biometrics Retaken due to they didn't take right my fingerprints.
