hellow everyone I was just wondering if there might be a problem with our petition forms I130 and I485. We filed in March and had our NOA1 sent out on April 4th. I have already done my biometrics and my EAD is currently being produced. I have noticed that many of you have gotten your case transfered...should I be worried that mine has not or is common not to transfer a case?

12/1/2005 began dating

1/5/2011....married my high school sweet heart and love of my life

3/18/2011...I-485, I-130 and I-765 sent via immigration lawyer

3/28/2011...I-485, I-130 and I-765 and payments received by USCIS

4/4/2011....I-485, I-130 and I-765 NOA1 all separate forms sent out

4/8/2011....Received via postal mail I-485, I-130 and I-765 NOA1 for all three forms

4/ 25/2011...Received biometric appointment for (May 18)

5/18/2011...Successful biometric appointment

You are required to have an interview as you are not adjusting status from a family based visa. your case likely wont be transfered as most transfered cases do not have interviews.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

but wouldn't our I130 petition be family based?

It is not the petition, your are adjusting from WORK / STUDENT OR TOURIST.

A family based AOS would be an AOS from a K-3 visa or a K-1 visa.

OP - You will have a mandatory interview at your local USCIS office. It's been only a bit over 2 months; your interview letter will come in the next few days or few months. Good luck.

8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

Don't panic. I did biometrics in Dec. 2010 and heard absolutely nothing until mid-May 2011...No touches, no RFE, nothing!

so it took a little over 5 months with no updates until your interview in mid may... was you case ever transfered between that time frame

Your type of case does not get transferred. You will have a mandatory interview at your local USCIS office. You just need to wait until you get your interview letter. You have confused yourself by reading the AOS from K-1 forum - their process is different and you cannot compare them. I repeat - you case will NOT be transferred.
