I am an American married to an Israeli. I have been living in Israel for the past 2 years and we are now considering moving to the US. I hear it is quicker if we file here in Israel the problem is I would like to go back to the US to find work and establish a residence. Does anyone know if I can do this while the 130 form is being processed? I have not worked in 2 years does anyone know if money in the bank counts towards the support affidavat? How much money would be required? Can my husband visit me in the US during the process?

hello,

after you have filed the I-130 form and it has been approved then you are free to go back to the usa, you do not have to be at the interview.

as for money in the bank, yes, but it counts as 1/5 not the full amount. the amount required depends on household size, read the instructions for I-864 very carefully. It would be hard for your husband to visit with an immigrant visa pending because he needs to prove strong ties to israel and having a wife in usa in process of immigration would probably be an issue.

good luck!
