All Documents were Approved by NVC but Embassy still gave Refusal Worksheet (Blue Sheet) saying Petitioner's Income not Sufficient

Not to hijack here, but I have a similar question. My father will be a co-sponsor as well. He has not claimed me as a dependent for 2008, 2009, or 2010. However we DO live in the same household. For 2008 and 2009 I was a missionary for the LDS Church in Mexico and did not have an income (no taxes filed). I am a little confused about whether my father should flie out I-864 or I-864a as I have been told two different things. Help!

Hi James,

Our original co-sponsor was not accepted by the CO and my husband was told at his interview to find a new co-sponsor. Once we sent in the new co-sponsor paperwork it took 3 months for the embassy to review it. You are now in Administrative Review/Administrative Processing. Email the embassy every week to check the status of your case or call the Department of State.

Carolyn i think his info also said that the petitioner does not make enough to find a joint sponsor...what did your paper say? was it the same? or did it actually talk about the co sponsor?

I sent my fathers 2007-2009 tax documents. I was a dependant in 2007 and 2008 but not a dependant in 2009. I filled out 1 I-864 for myself and an I-864A for my father. And yes we live in the same house. My father with his assets has quite a bit more than the povery guidline. Does this look alright??

Sometimes the type of assets make a difference as well bcos if they arent' easy to liquidate such as real estate they my not accept those or if its the main living residence etc... how much over poverty line is his actual income and how much in assets and what type of assets (ie...vehicle,savings, land, house equity, stocks,etc) is he providing?

Hello James s,

If you read what "magical" stated, I think you will get some good piece of information. Every time your documents goes to one department (USCIS, NVC, or Consulate), it is within their jurisdiction and the previous group has no control on that. Good that you are clear that NVC has nothing to do with the decision made by CO.

One thing I want to state that everyone can make mistakes, whether it's you, USCIS, NVC or even the CO. Now you (all of us) being on the receiving end can't complain or make too much fuss if the other end makes a mistake. So as "magical" was saying even if your document felt down the crack or somehow was ignored by someone somewhere, it's not a big issue. I am sure you've done your homework already and know what documents you need to submit. In that case, don't pay too much attention on all other distraction. Waiting 4 days is not that big of a waiting. Whatever your wife submitted will be evaluated by the CO and then he will either say "OK" or talk to your wife again. Not sure about the process yet. Why it takes time, because your wife is not the only person the CO is dealing with. So she may have to wait for the next empty slot and that can be 5 days, 6 days, 10 days, or whatever is the next available date. Also, as many were saying, your problem isn't a serious one. She wasn’t rejected or refused by the CO, but asked for some specific information. If you think you have that piece covered, you are all set. You should be jumping up and down now :-)

That might be an issue. I am not sure since it has passed thru NVC. To get the correct household size for your father he should have done another i-864, you should have done an i-864 as well.

WOW! 3 months!?! My wife was never given any paper which said she was under administrative review. Was your husband given a sheet which said that he was under administrative review? What is the email that I can ask the status of my case?

Administrative review is basically a catch all term that means anything being done to your case between the start of your case until you are actually approved (or denied). Because your case is now being looked at because of the affidavit of support issues, your case is under administrative review. As someone else said, and I agree, you should have copies of everything you sent in. Go back and look at it all very carefully. Look at it as if you were a reviewer. Look for clerical errors etc..... Also, there is a formula for the co-sponsor to qualify based on how many people are dependent on him etc.... sometimes it is not just the magic number of poverty level. This may be the problem, you have to fill out an I-134 for yourself and the I-864 for the co-sponsor. I am just going by what the instructions say and not personal experience. Just trying to help you figure this out... The link I sent explains my rationale...

04/06/11 Automatic recorder on the NVC machine stated that my package was received this date and have to wait 6-8 weeks for next responds
