All Documents were Approved by NVC but Embassy still gave Refusal Worksheet (Blue Sheet) saying Petitioner's Income not Sufficient

Hello everyone,

My documents were all fine and were approved by the NVC. I checked with the poverty guidlines before submitting my affidavit of support. I only had a Certificate of deposit on my name 2 years ago which was the the reason I had to file taxes. I am a student and therefore have never been employed. My wife went to the interview and they asked her some questions about the wedding and she replied and showed pictures, etc. At the end they gave her a "Refusal Worksheet" This is the Blue sheet. The Section 221(g) is checked. It says that your petitioners most recent income is not sufficient to sponsor you. A joint sponsor is needed. I was the petitioner and I do not have any income so that is why I used my fathers income plus assets to sponsor my wife. They held her passport and asked her to bring in the affidavit of support again of someone qualified to support you. I mailed her my fathers affidavit again along with all the documents required as well as an additional joint sponsor just in case and now they are telling her that they will giver her a call. Its been 4 days since she submitted the documents and there is still no phone call.

I do not understand why the NVC would approve my affidavit and the embassy would tell her that the petitioner does not have sufficient income. Can it be that they only looked at my tax documents and overlooked my fathers? I tried to call the embassy but they are no help at all. I call them and they just transfer the phone to a machine which disconnects me. Once I get a live person to talk to me they shut the phone on me.

I would really appreciate it if someone could help me out with this situation. I am really lost and do not know what to do.

I understand that.... but the reason they gave is that the petitioners income is not sufficient. I did not use my income. I used my fathers. The only reason I submitted my tax papers was because they required them. I was never employed just had to report some interest on a certificate of deposit I had.

Listen closely--NVC doesn't approve anything--it is all done at the consulate, so forget the NVC at this point--you are way beyond that.

If you think your father's income/assets more than pass the test, then you are fine, but if you don't or you submitted the wrong form or he didn't sign and date it or there is a clerical error on the form, or somehting on the form doesn't match his tax return, or, or, or...

You are panicking after just four days ?? Get real--and they will give you the answer after they evaluate your father's and other freind's information--nothing will speed it up or change the outcome. In the meantime, look at every single entry on the forms you just submitted to be sure nothing is missing, no inconsistencies, the right form was used, signatures and dates are there, etc, etc. If you find a mistke, you know what to do to fix it if they come back to you again.

In the meantime, cool your jets and use your energy to really study the problem--you are probably panicking your wife as well and that just isn't necessary.

carolynhotstuff also had a refusal for the 1st interview...contact her ask her what they said bcos they said they couldnt accept her co sponsor she had to find another one...you can compare notes but you wont actually know until the letter comes from them telling specifically the reasons... and yeah im a little worried too bcos i make over the poverty line but barely and last year i did as well..but i also have over 100k in stocks that I can liquidate at a moments notice...but ultimately its embassy not nvc.... :wacko:

I understand what you are saying and everything you said makes sense. The reason I am concerned is because the Embassy stated that the "petitioner" does not have suffcient income. I am the petitioner and used ONLY my fathers income and my father is NOT the petitioner he is the household member/sponsor. I just thought that the Embassy made a mistake. Any thoughts?

hi james dont worry my inter was last month embassy gave to me Refusal Worksheet. officer say ur wife income is not good .and u need a joint sponser . den i sent a joint sponser ducument den US embassy

emailed me few days ago say The joint sponsor documents you provided are acceptable.

Something may have fallen through the cracks or your father's documents were misplaced--the good news is that they will approve everything as soon as this little--yes, I do mean LITTLE--issue is resolved. You have no worries if your did's numbers make the cut. If they don't, then hopefully your fallback sponsor does.

You are almost home--smile and rejoice !!! And stop fretting about how long it takes--every single case is different and there is nothing to be learned from someone else in this case. It may have taken them a day and then you will fret more because you are at four days or it may have taken two months and then you will fret that it took so long.

There is nothing you can do, so just enjoy thinking about how great it will be when this last little step is complete !!!

WOW! 3 months!?! My wife was never given any paper which said she was under administrative review. Was your husband given a sheet which said that he was under administrative review? What is the email that I can ask the status of my case?

I sent my fathers 2007-2009 tax documents. I was a dependant in 2007 and 2008 but not a dependant in 2009. I filled out 1 I-864 for myself and an I-864A for my father. And yes we live in the same house. My father with his assets has quite a bit more than the povery guidline. Does this look alright??
