Which embassy processes the K-1 visa application (Czech Republic)

Hi,

I am a British Citizen living in the Czech Republic and have recently had my I-129F approved. On the I-129F petition my address is clearly stated as in the Czech Republic and I put Prague for the embassy where I would apply for my visa. This week I received a letter from the NVC saying the case will be processed in London.

Is this correct due to me being a British Citizen or have they messed up? I can't imagine a British Citizen living in Australia for example being asked to travel to London for their interview.

If they've messed up, do I have to take action to get it fixed or will it fix itself? The Embassy in London seems to be impenetrable when it comes to getting information.

I looked at the Czech embassy reviews here on VJ and there were a couple K1s. That does sound strange that they say it will be processed in London! Did your fiance ask the NVC why they said it will be processed in London? You should get the your fiance to call NVC or if all fails contact his congressman to find out what the deal is.

Fiancée lives with me here in Prague.

I tried to call the NVC (AVR) and they said they could not do anything as the paperwork was with the embassy and I should contact them. Have been unable to contact London and have had no reply from Prague.

Yes I was wondering, like you, whether there was a reason NVC sent it to London, like maybe they may do very few K-1s at Prague?

Would it be a problem for you to do the interview at London? From what I hear London seems to be a quite straight forward embassy to do interviews at. I don't know how long London takes to send out the packet to you and how long since you were told that London has your paperwork.

Maybe other people here can tell you about Londons processing time?

It has nothing to do with your citizenship... somehow based on the information provided they made a determination (however wrong) that your current place of residence was in the UK...

If you want the interview in Prague, you need to contact London to get it transferred. It will NOT correct itself

Contacting the Embassy in London however is easier said than done. The phone number can't be called from outside the UK and the email address sends an automatic response saying my mail has been deleted unread. Any suggestions?

I would go over to the UK forum and ask this. There was once a trick to the e-mails by including your LND number in the subject line but don't know or remember exactly

Not a huge problem no, but I was reading one post, I think today, saying that they went though the visa process at an embassy in a country where they were not resident (Dublin?) and the interview was cancelled at the last moment when the embassy realised they didn't have jurisdiction.

You are right, I just looked up the Embassy Information here. London only does interviews for residents. Sorry, some embassies, like the one my fiance will be going to doesn't require her to be a resident.

In that case you certainly need to get hold of them, in London to send your package back to NVC. NVC would have to give you a case number for Prague so you can interview there.

Thats terrible they screwed up your case! :wacko:

Well the US Embassy in Prague has responded saying they can request the file from their colleagues. This is positive but I'm sure it's not just a case of Prague phoning London and asking for the details. My guess it has to go back through the NVC, how long this will take God only knows.

London should have received my details a couple of weeks ago, but I have heard nothing from them. Would I be naive to think that they noticed the mistake and sent it back or would they just put it on a pile and think "Not our problem"?

Good to hear, it sounds like they have some process to handle situations like this. Ideally they shouldn't need to send your whole package to NVC, I mean they should have your info electronically and just give you a new case number for Prague. But then we all know government does nothing efficiently.

Its a mess, but at least Prague is trying to straighten it out, it could have been worse all of them could have said "not our problem".

That's good news. I imagine that's exactly what has happened.... London has recognized that it's not their file and that's why you haven't heard from them. When the mixups happen at the Canadian Consulates (~5,000 kms apart) they do just send them directly to each other and do not send them back to NVC, so here's hoping that the European Consulates do the same.

Unfortunately we gave London too much credit. Yesterday I received a letter from the US Embassy in London telling me to complete the forms for the K-1 visa. I doubt they even looked at the details, just pressed a key that printed out the standardised letter and put it in the post. Although I don't know how a letter, dated the 23rd May, didn't get to Prague until the 2nd June. Airmail in Europe takes 5 days max and from capital to capital should take 3 days.

The Prague embassy don't seem to be doing much in the way of anything.

The annoying thing is that the I-129F petition clearly states Prague, the NOA2 clearly states Prague, yet some bozo managed to send it to London.

So in a rage I called the NVC and this time they actually listened to my problem, last time they fobbed me off saying they couldn't do anything, and I was told that a supervisor is on it and will email London to tell them to send my details to Prague. Perhaps finally someone will do something, nearly 40 days after the I-129F was approved.
