I just called the pre-clearence # (thanks canadiangal) and the man I talked to this is what I told him " My husband recently had his immigrant visa interview in Montreal & got approved and recieved his IR-1 visa, when he was 19 he's now 32 he got arrested for a couple things, he asked what and I told him what and he said as long as they got withdrawn and dropped then it's okay. I also told him about the theft under 5k and how it was a conditional discharge and a summary conviction and he said thats fine. He asked me about the lady interviewing didn't he my hubby tell her about it and I told him "yes he disclosed all his info she questioned him about it and he even let them know before and answered yes to ever being arrested. and he said "if the office/embassy approved it then its good" So I guess this is good, but I'm still nervous.

I mean his cr-1 " conditiona one I told him. And I told him he has his sealed enevelope and passport & if he needs his x-ray and he said no, not his x-ray that's for adjustment of status or something.

what is your husband doing his POE, I will be doing Saturday.

Don't worry everything will be fine, best of luck

Chman_Zinga

He will be doing it in a couple of weeks, he has to prepare some things. thankyou! Good luck to you also, congrats! Let me know how it goes =) ru doing it in Pearson?

Do you guys know if the limit of baggage is more for activating the visa? Or if it's more than one check in, then you pay the regualar fee for the rest?

Also do you guys know from past expr. what kind of questions they could ask at the secondary location, and what forms would they ask my hubby to fill out? the customs dec, should he fill it out prior to going to them or it has to be infront of them? And he dosen't fill out a I-94 right?

We are really curious what they do when they take everything out of the enevelope......is it just to make sure that whoever got issued the visa is the person standing infront of them trying to POE? And fingerprints check for any current warrents and stuff?

Thanks you guys! :star:

The baggage limit does not change. Whatever the airline baggage allowances are is what you get.

There really are no questions. At Pearson he will pick up the I-94 form and fill it out before he heads into Customs. He will hand that and his passport over to the officer and let them know he is entering on a CR-1 visa. The officer will send him over to secondary where they will take his envelope and process his entry. They will take his biometrics and his picture, stamp his passport, and send him on his way. Easy peasey.

Easy peasey lemon squeezy LOL I like that. Umm I-94 ? is that the same as the customs form, I thought only K-1 visas fill out the I-94.

I'm sorry. I don't know whether they get I-94's or not. They must have to fill out something, though. Is it the blue forms? Please ignore me. lol

it's okay! Blue form, i've never heard of that. hmm maybe someone who's poe'd recently on a CR-1 visa will chime in soon lol

I did not POE through Pearson (my POE was Edmonton) and they (the CBP officers) wouldn't let me activate my visa until I was actually crossing. I had to fill in a customs declaration form, was sent to secondary and it took probably 45 mins for them to finish up all the paperwork. Not one time did they bring up my past criminal issue BUT every time I had crossed into the US I went thru Edmonton so they already had my file there.

Also, I never, EVER had to file any type of waiver to visit the US (not even as a non-immigrant) so my criminal past was never any type of issue for me. The only time it was an issue was during the final stage of my CR-1 process because the interviewing officer had misinterpreted the "petty theft" exclusion rules.

Good luck with everything, I'm sure your hubby will be fine. Truly, it's ultimately up to the POE officer but try not to stress too much.

What do you mean you went through Edmonton so they had your file there....like you have been to that airport and traveled in and out before? My hubby has been through Pearson a bunch of times...like more than 5 or 6. So they would have his file? So your DS-230 had yes under the "have you ever been arrested, charged, or convicted" and the people had to have seen it on your DS-230 in the airport and they didn't mention anything about it. I remember you saying you went to the airport to speak to the customs guy didn't you? I called them the other day and spoke to them.

The only thing that bugs me is during the interview time in Montreal the 1st person we saw apart from the lady who interviewd us, it was a man he was cool, but whipped out my hubbys DS-230 and said okay lets go through this together and marked with a pen like a little line on everything he went through....the address, my address, where he wrks, our #'s and then he asked a question about the being arrested stuff in the past then circled the # of that arrested question then jumped to another question.....but the interview lady did ask about it. But it's feels weird the fact that he circled it I feel like the CBP are gonna notice it even more now rather than the number not being circled. But when I talked to the man he was more concered about if we told the consulate, and the fact that we did and they gave he said we wouldn't have a problem, and they just want to know if he was convicted or not, and when I told him 3 of the charges were withdrawn he was fine with it.

so i dunno anymore.

I think sweetcheeks means they had her on record, not an actual file. So if you've been traveling out of the same airport, they'll have a record of your entrances and exits

He'll have to fill out the customs form, the blue form, like he's done every time he's gone to the US, the'll surrender his envelope, they'll open it, go through it to make sure all the documents are there, and ask him a few questions. I was asked very simple ones about my marriage and relationship, reminded that I had to remove conditions, and was sent on my way. YYZ is a very professional and courteous POE - they are, however, also quite busy

Good luck

Glad to see you are still around :)

I also agree with this, I had no problems until the interview and when I poed they never mentioned my "past". The only question they asked was if the address was correct :)

What do you mean you went through Edmonton so they had your file there....like you have been to that airport and traveled in and out before? The lady I got circled and went through everything with me to, they cannot circle the "record part" as the interviewer needs to go over it. It did not make the POE look at my stuff anymore than anyone else.

Yup, that's exactly what I meant. The pre-clearance in Edmonton already knew everything about my past (trips, criminal issue, etc) because it was my home airport. Never once did they request that I had to file any type of waiver to enter as a visitor OR when I processed thru with my CR-1. So I suppose, *IF* the CBP officer that processes your hubby in, isn't aware of his background, it could potentially turn into a delay while they figure everything out. In my opinion, maybe he'll be delayed for a bit extra at POE. Ultimately tho, of course it's up to officers at his POE.

Good to see you too canadiandggal!
