K2 what do you need to start FTJ

When it comes to FTJ on a K2, the HCMC consulate needs you to provide the following:

a. Letter of request for FTJ status clearly indicating applicant's name and contact information in Vietnam.

b. Proof of petition approval such as the original Notice of Approval (Form I-797) received when the visa petition was filed by the petitioner.

c. A copy of the birth certificate for FTJ applicant.

d. Proof that Beneficiary in the U.S. has now adjusted status under an existing and current fiancée visa petition such as a legible copy of her green card (Form I-551).

These required documents should be submitted in person to our Information Unit, 4 Le Duan Street, District 1, Ho Chi Minh City. Our working hours are 8:00 – 10:00 AM or 1:00 – 3:00 PM, Monday through Friday, except holidays. We are unable to accept the requested documents by fax. Once these documents are received, we will determine if Benficiaries child is eligible for "follow-to-join" status; if so, we will create a case and start processing the follow-to-join application.

Please note that the child of a fiancée K-1 principal alien may be accorded K-2 status if following to join the principal alien in the United States even after the principal alien has married the U.S. citizen fiancé, and acquired lawful permanent resident (LPR) status. However, the cutoff date for issuance of a K-2 visa is one year from the date of the issuance of the K-1 visa to the principal alien. After one year, and provided that the alien qualifies, the filing of an immediate relative or second preference petition would be required.

They didnt say anything about not accepting them via mail so we mailed them certified.. its not cheap flying back and forth from HaNoi... Just found out that they say they dont have the documents that were sent so a trip to the post office tonight will let us know who failed...

the vietnamese over there are really unorganized! i gave them a call earlier today asking for a CRBA update since it's been 5 weeks. the viet lady looked up the info and said crba/passport still not there, then asked ME if the CO requested anything extra on the case...wouldn't she know better than me since she just looked up the information? seems like they're just there for data entry and there's no flow of communication at all.

argh c'mon get ur $*)% together already :bonk:

Just figures that the documents the signed for on May 25 they send my congressman a letter today saying sorry we cant proceed with the process because the documents received yesterday were missing NOA2... funny how it got lost between then and now...off to VN express to send another copy in the AM... Had I sent the original that would have been a significant 300$ screw up.. they only have around 90 days or so to issue the visa... 2+ months of delays so far.

When we were in AP I really though the folks at the consulate were a bunch of douches... then I put it behind us when we got the visa.... oooops.. things have not changed... When we filed for Thuys green card, we had to send the NOA2 from the original petition to get the green card... I made copies color front and back... so now here we are with the consolate saying they want the original after having been sent the true copy twice for sons FTJ... if I recall its around 300 usd for the USCIS to issue a new NOA2 and by the time we get it he will have timed out his 1 year... heading back to the states on Monday night and will be in the congressmans office with the document in hand on Wed AM to see what we can get done. been trying to get his FTJ now for 3 months.. they really know how to screw with someone... I just can't see him getting here in time to start school as planned.. for that matter my wife thinks they dont want her or her son in the states after all they have put us through... I dont blame her...

:whistle: Amazing that the consulate is now ignoring my congressmans inquiries. two inquiries in a month regarding the fact that we have provided what they asked for and they still say it is needed as if we didnt submit it... the clock is counting down now since there is a 1 year time limit on the FTJ visa being issued and that time runs out in around 8 more weeks... the past 3 months has been wasted on miscommunication and the lag between responses.. eager to see what they have to say when they finally answer someone...
