Apply Date of I-130 - Feb 22, 2011

Received NOA1 - Feb 28, 2011 ( which is priority date on Receipt)

Apply for citizenship N400 - 1 March

Interview Done - May 6, 2011

Oath - June 9, 2011

1. Now What I need to do for upgrading my I-130 petition from greencard to citizen.

2. Does the waiting period count as my original priority date of I-130 is 28 Feb, 2011.

You will need to wait until you are a US citizen to update your petition.

After June 9th Oath you will be a US citizen. Then you can call USCIS and request an update from LPR to USC. You will likely need to provide proof.

Your interview took 67 days from your I-129F NOA1 date.

ya, the visa # will be available immediately, but in the same breath, it does nothing for the USCIS queue on I-130 approval.

Usually, it's after the I-130 approval where 'the change' is useful.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

you know what..that's really good you apply before you got your citizenship.

someone told me do that but i think its gone too long to get my husband here. i did not apply for I130.

that time i think its faster way to apply from india & my husband gone get here in 3 months.

because my bro apply for his wife in april 2010 she get here in july.

but i try in Oct 2010 from india they could not accpet my file after i was citizen.

i have to comeback from india then i apply for my husband.

I would THINK that your priority date would be the date you upgrade your petition to USC because it's a different "queue" but someone else would need to confirm that. It makes sense that that would be the case because otherwise you're jumping ahead when you weren't eligible to be in the Feb USC group when you filed your petition so now you would be the June USC group.

From what i heard he has to wait 5 years the day he got arrested. So no he cannot apply now. 5 years from the day he got arrested.

but someone told me if you are usa citizen then you can go with your spouse.

if you are not then just apply for him. when you got your citizenship just call them you can upgrade your status.

if you are usa citizen then your spouse can get visa in 3 months from india..if ur not then u have to wait. but now not any more i think.

because after i got my citizenship i go back to see my husband..i try to apply from delhi 2 times...they did not accept my file.

so i send that file to my bro he send for me too Chicago then i came back in march.

I guess that's the smart thing you do by sending ur I130 to brother and have him mail to USCIS, at least you save some time by doing so....
