send in My AOS and EAD package 22 days ago and no answer!!

Hi everyone,

I entered the US on March 15th with my K1 visa

got married on April 8th and on May 3rd sent in the application package for the AOS and an EAD as well (to the Chicago lockbox)

It's been 22 days and I have not received any notifications nor was the check cashed.

When I called I was told that I have to wait until 30 days go by (!!!!!!!!!!)

When I entered the country I got a temp 90 day work permit stamp on my I-94, but it expires on June 13th.

Is there anyway to extend that? Or is that the EAD (which I understand takes about 3 months to get)

What happens after I get the NOA1? Will I be legal after June 13th?

I feel like I missed something...

Does anybody have any light to shed on my situation?

It's not easy waiting but don't worry yet. Many recent AOS applications have been running 30 days or more before check cashing and NOA1. You're getting close!

As for the temp work permit, I'm not sure that was ever valid. I've heard that only JFK issues it and that is in error.. Are you working now?

Did you mail yours regular mail or express? I sent my AoS and EAD last May 11. I noticed from Visajourney that most AoS applicants received their NOA1 within 15 days. I too am worried. Check, not yet posted either....

HEY! Don't worry guys! It's been usual lately to receive NOA after 30 days! I know it's not easy and worrying is just normal, but don't freak out! USCIS will get to your packet and you'll hear something from them very soon!

ETA: I know in situations like this we get a lot of "Don't worry" and "Hang in there", but really that's what's going on at USCIS service centers. Many, many filers (esp. March and April) that I know have waited 30 days or more to get the text and email notification. So, in a few days you should be receiving a notice and if you don't, then you can always call USCIS and ask about your petition.

The stamp in you passport is NOT valid for work. It might say that but it's not (used to be but not anymore). I sincerely hope you have not been working as you have been working illegally. JFK is usually where they give these out and they're not supposed to because they confuse people into thinking it's legal when it's not. The I-9 employment verification form does not accept the stamp as valid proof of employment eligibility.

No there's no way to extend the stamp but it's not valid anyway. The only legal way for you to work is to get an EAD which you can apply for with AOS (which you've done). Until then you are unable to work.

Once your I-94 expires you are out-of-status. If you have your NOA1 issued though you are in a period of authorised stay from that date.

I haven't been working since I came.. I have been feeling quite guilty for missing my chance to work, but I guess there's no reason for that

So what happens if I don't get the NOA1 before the I-94 expires? (mine will expire in two weeks and still no sign of anything..)

Hey!

I see I am not the only one in that situation. I did not get my notice from USCIS yet either. Even it's just 2 weeks... I called them, and they said the same... wait 30 days (((

So do not worry! I will try not too ))

And about 1-94... When you will get your NOA1, you are legal, even if i-94 is expired.

Nothing will happen. You might be out of status briefly if your I-94 expires before USCIS accepts your AOS application, but it won't affect the approval of your application at all. Many K1's don't send their AOS application until after their I-94 expires, and it's never an issue.

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

For your safety until your NOA1 arrives, I recommend that you carry with you a photocopy of your cover-letter (and, ideally, of the check for payment) for your AOS package. This could mollify any Federal agents (or members of local or state police agencies who have ties to ICE programs) who seek to harass you.

I always made sure that my fiancee-eventual-wife carried a copy of THE most recent paperwork with her, regardless of what it was. Anyone who considers this to be overly cautious is reminded that Federal agents are not our friends.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
