My fiance is getting ready to prepare the AOS package and I am required to fill out the I-864, I have a few questions on the Application. I am still in school therefore my co-sponsor is my mum. I live in GA and my mum lives in FL, do i need to ask my mum to fill out the I-864A also or do I fell out an I-864 and my mom fill out a separate I-864 ???

My other questions is on My I-864,

1. In Part 5 question 21 - I am confused as to how to fill it up, the count.

2. Part 3, question 8 - Since i do not have the money so i select yes or no ?

If he or she is still your fiance then you can't file the AOS package yet. You have to get married first.

Unless you claim your mom as a dependent on your tax returns then she won't be able to use an I-864A. The I-864A is only for qualifying relatives living in the same household, or dependents of the sponsor. Your mom will need to fill out an I-864 that reflects her own income and household size. Your spouse (the immigrant) will be included in her household size, but you will not.

Part 3, question 8 - you must check "yes". You are the primary sponsor. The only time anyone would check "no" is if they are a joint sponsor, and there is another joint sponsor who is sponsoring the primary immigrant, and they are only sponsoring one or more of the derivative immigrants. From what you've said so far, this wouldn't apply to anyone in your case - not you and not your mother.

The number on line 10 should include your spouse since you should have checked the box on line 8. If your spouse is the only immigrant (no K2's involved) then the number in the box on line 10 should be "1". In part 5, question 21, you enter the number from line 10 into box "a". All of the other boxes in question 21 are for people who are NOT being sponsored; e.g., other dependents. You do NOT enter a "1" in box "c" for your spouse because he is the one being sponsored. However, if your mother is married then she WOULD enter a "1" in box "c" because her spouse is not being sponsored. The rest of the boxes are pretty obvious. Enter the total in line "h" to determine your household size. If your household consists only of you and your spouse then the number in box "h" should be "2".

Thank you sooo very much. I got officially married 4 days ago. Prior to being married i was a dependent. Currently i am unemployed since i am still in school and my mom is the co-sponsor for my husband. So therefore on Question 23 and question 24 i would have to put down $0.00, right ?

Secondly my mom will fill out the I-864 also since we live in 2 different states.

For my moms I-864 on part 5 question 21(d) does she have to put down 1 for me also ?

Does your mother claim you as a dependent on her tax return? If so, then yes - she has to include you in section 21, either box "d" or "e".
