Massive Headache at NVC

Timeline

Long story short for the first part. I need to know if anyone has had any success in bringing their spouse in before the NVC has completed their processing. She is going to loose her place at the end of June as her room mate's brother is moving in with no notice.

The back story on this is that I submitted all of my documentation to the NVC on 3/23/2011, have usps proof. They claim to have not recieved it. I sent a second copy, nothing thinking about it being a copy, so they rejected. After speaking with numerous supervisors one did tell me that she did not see it but to send a third copy attention to a department and request expedited processing. I'm now told they rejected the expedited processing because they claim to have never recieved the original.

I have proof and have sent this proof to the NVC numerous times. They can not find it but refuse to say they lost it. I need major help, we are going to pass our one year anniversary and not even be together.

If anyone has any suggestions on who to call please let me know. If I try USCIS they tell me NVC, NVC tells me USCIS. I have a number for the State Department that I will try tomorrow.

I saw another post on a different forum about NVC having some "isssues' lately. Seems they send notice to say they had a document, then a week later say they don't. Even if the issue was resolved at this point, its May and appointments are a couple months away in montreal aren't they? It would not change your fiance living situation.

Keep pestering them maybe they will find your document. Not sure why they can't use a copy and verify at the consulate against original.

While yes that is always an option, the problem is that my wife was laid off due to economic reasons and hasn't taken another job yet as we were right on the 20 day mark for NVC. This will make it a lot harder to get somewhere, and family is not an option.

Why is it that there is no recourse against the NVC if the loose a document?

We have had good luck by emailing them. We don't complain or whine, we just state the facts firmly. Usually within 48 hours they have corrected themselves and we go to the next step. THis has happened twice in one week. So going forward we will continue to emal them with the facts. No emotion, no begging. It works for us so give it a try. Good Luck!

Have you called your congressman or senator yet? Some people on here have had luck with that but be sure to tell them you want your case expedited because your wife is now facing homelessness because of the mistake. Overnight another original Affidavit of Support with huge lettering on a cover page saying "3rd Submission, Please Expedite". That's just what I would do in your position...good luck & keep us posted.

Thank you for the response. I have been contacting my senator's offices, been working with them as I got stuck at USCIS. That part does not help right now. One supervisor did tell me to overnight it with attention to that department and a request for expedited service. It was declined for expedited, they tell me that they didn't loose the original just haven't recieved it. I sent a printout of proof from USPS in my package in addition to emails from before so they have the proof in front of them.

Can you try consulting with an immigration attorney by phone tmro to see what they suggest? I found a NY Immigration hotline that I have called with various questions & they have been very helpful 1(212)419-3737..or see if they have that where you are.

So, apparently I got the right supervisor last night as I got a letter from the NVC. When I filed this affidavit of support on 3/23 2010 taxes were not required to be filed. So I followed instructions and included only recent years filed. I filed an extension to these as my wife is not allowed to even cross, not enough evidence that she has ties back to Canada. My Tax professional told me to file an extension and she can fill out the forms when she gets here.

They've had this and lost it from 3/23, now it's past that and since there is no accountability at the NVC I will more than likely have to file yet another copy of the affidavit of support. To make things worse they had a copy of it without the signature and couldn't say anything then?

Really, what is the point of the NVC? Why can't our spouses come into the United States while waiting on this process? Have the american citizen sign a release stating that they will be legally responsible for their spouse? People that have entered this country illegally have more rights than my spouse.

Long story short, I'm going to try to push this over the phone but it looks like another affidavit of support and another 20 days.

I will not be with my wife on our one year aniversary, and I'm pretty sure that this is going to put even more strain on the marriage. It has taken over a year now. I'm disgusted with the whole immigration process of the United Staes, absolutely disgusted.

Well, although the NVC often loses/misplaces/says never received things, I read that before the NVC was implemented the consulate posts used to do all of it and they couldn't handle the workload so Immigrant Visas took years sometimes. I know its frustrating but just hang in there! You're almost done, and some people are getting much worse RFE's than yours. Soon you'll be together and this will all be a distant memory.

:thumbs: Get your Senator and congressman's advocate involved. this is what they are for. go to their website and download the form giving them authority to act on your behalf and fax that to them and then call them.
