How Soon to Sponsor a Child ?

Hey,

I am in the middle of K-1 petition for my fiance, he has a 5 year old daughter in Cuba. We are not sponsoring her now, but we are wondering how soon (after he gets established here) can we sponsor her ? Do we sponsor her together or will one of us have to sponsor her separately ? Can we bring her when he has his Conditional Perm. Residency or do we have to wait until he gets the conditions lifted ? Or can I sponsor her myself, being her step-mother ? Sorry, I tried reading through the FAQs but still have some questions.

My Timeline

Dec 2008: Met my baby

Dec-July: Spend a million dollars on phone calls :)

July 2009: Visit to Havana

February-March 2010: Live together for the first time

April-December: Emails and texts and chats oh my !

January-March 2011: Together again ! Sooooo happy

November 2011: Went to Havana for the interview and we were approved ! Now on the the carta blanca

K-1 Visa:

03-24-2011: File I-129F

03-28-2011: NOA1

03-30-2011: Touch

04-22-2011: NOA2

04-29-2011: Case Forwarded to Havana

04-19-2011: My fiance received packet 3

11-01-2011: Interview Appointment. Approved!!!

11-02-2011: Received Visa

04-25-2012: Arrival in LA Airport!!!

06-08-2012: Married!!!

Adjustment of Status:

07-24-2012: Mailed AOS papers along with AP and EAD

Why not go K2 and bring her over later?

If you don't use K-2 Follow to join (needs to be issued within 1 year of the K-1 parent's visa) then the USC Spouse can file an I-130 petition for a CR-2 Visa as soon as they can prove they are married to the child's father.

The USC Spouse would be the petitioner as then a Visa Number would be immediately available for the child.


Must have info for bringing your Philippine wife/fiancee's child to the US
