B2 Visa (for father) got refused second time (this time without reason)

Funny thing: I asked one of the top immigration lawyers in Colorado about bringing my mom on a B2 visa, me being in your same shoes (K1 visa initially, now with a conditional GC).

He said: it is best to send the Affidavit now, while I'm a conditional resident, because the Officer interviewing my mom will consider that since I myself I'm only conditional, the possibility of my mom wanting to stay in US illegally is unlikely. So, according to him, best chances are now, as the conditional status works in our favor.

So, it looks like that CO interviewing your dad was not very professional when she said "wait until your son is permanent" (That would be the kind of advice you would give if you'd suspect he is looking to remain in US permanently)

So, at this point, no matter how you look at it, it seems that the CO's who interviewed him so far believe he has intentions to remain in US.

All the ones I have met concentrate on employment based immigration.

Most Lawyers like Politicians follow the money.

Most is to be found in Employment Based work, some do specialise in Family Based Immigration, I have never come across one that specialises in Visitor Visa's etc, no money in it. They may well have a passing knowledge.

But looking at the case, a PR conditional or not can not sponsor a Parent, a USC can.

So someone with a PR child could overstay and legalise when the child naturalises. Would not be the first time it has been done.

Visitor Visa's etc, no money in it. They may well have a passing knowledge.

Hmmm, I was counting on the fact that having to deal with USCIS on a daily basis lawyers learn to read their way of thinking. So, generally, people don't go to a lawyer when they need an Affidavit for somebody who will apply for a tourist visa; but, they tend to better understand immigration principles and USCIS's point of view through their experience.

I'm not saying that lawyer was right, but in my mind it makes sense.

I'm in the same boat: conditional PR, will remove conditions this fall. My mom had an Affidavit from my husband, applied for a B2 visa, and even though she has all the possible ties with Romania,she was denied.

So, if they won't issue her a B2 visa, I'll HAVE to apply for her GC when I'm a USC, not because she wants to ever remain in the US, but because B2 is not granted to her. Isn't THAT stupid ???? :bonk:

USCIS do not issue Visitor Visa's.

If you feel you need to provide financial support for a visitor then you already have a major problem.

This raises another issue, since the DS-160 is completely electronic, how is someone able to frontload it?
