Timeline

Hi CJ's,

we had our biometrics on May 21. passed the RFE for I-485 on the 20th of May. Does anybody know the time frame for EAD? does RFE affect or delay it? thank you so much

It's only May 24 you have at least 2 weeks to wait for EAD

Divorced !st November 2012.

Married only 2 years 1 month

An RFE is supposed to halt processing on all petitions/applications (including the EAD) The RFE notice would have noted this. Once the RFE is satisfactorily responded to, processing should resume on all petitions/applications.

Sometimes (it seems) processing stops, sometimes it doesn't - at any rate - any delay would be for the length of time it took to satisfactorily respond.

It takes 60-90 days to get EAD, and during the RFE time you're on time-out.. With this process all we can do is be patient..

My Journey:

We met through a study-abroad program in Shanghai, China in August of 2009

We got engaged March of 2010

I received my K1 VISA in 6 months (June-December 2010)

We were married 04/02/2011
I received my conditional 2-year greencard (AOS) in 2.5 months with no interview (April-June 2011)

Our son was born 02/03/2013

I received my masters degree in Speech-Language Pathology 04/17/2013

I received my 10-year greencard (ROC) in 3 months with no interview (March-June 2013)

My husband returned from deployment 06/20/2013

My naturalization journey took 4 months (April-August 2014)

I became a US citizen on 08/01/2014

Received passport in 3 weeks (regular processing)

I guess, it would take more than 90 days before EAD comes because of the RFE from I-485. i didn't know it would halt the process because of the RFE. i thought its because its a different application, it would go on by its own. its really sad :(

TIMELINE

3-25-11 sent AOS package

4-30-11 received hardcopy of NOA1

5-07-11 received biometrics appointment ( 5-20-11 biometrics appointment )

5-09-11 medical appointment done

5-20-11 Biometrics done

Put your timeline in your signature so you don't continue posting it in posts.

The I-765 IS a different form and different application BUT it's dependent on you being eligible to AOS. When you get an RFE for the AOS that's saying you're not eligible which means no I-765 or I-131 for you until you reply to the RFE and make yourself eligible again. If you don't get an RFE they assume you're still eligible and you'll get it while waiting for the GC.
