I have been having an issue recieving my green card for almost a year. I have applied for I-751 in late June 2010 and got an approval letter on September 2010. Waited for 60days, and never recieved my green card, so I called USCIS and they told me to file I-90 without a fee, so I did as they told me. I didn't hear much for a long time (but checked in with them here and there), and I recieved a decision letter on May 3 2011 saying that my I-90 was denied because I didn't include the fee. Meanwhile, my husband (US citizen) found out that he got accepted in a job in Japan and he will be leaving in mid-July. With a senator's office's help, I'm reapplying for I-90 again, but I was wondering if I should wait to apply for I-131 until I recieve my green card.

If I apply for the I-131 now, Can I apply it with I-751 approval letter? I also got a stamp on my passport on February and it's good till August (i-551 stamp evidencing of my permanent residency).

Or should I wait for my green card then apply for I-131?

Any advice on this case would be very helpful.

when you applyed for your 1-751,did you get a receipt noa-1 797, letter, did it say you have a one year extension,if so you can traval with that letter and your old permanent resident card, ehen returning to the us poe.you should call again the 1-800 number get a two tier officer explain to him what happen, you where approved but never received your new permanent resident card.good luck

You are a LPR, so whether or not you have the actual Green Card in hand, you are eligible to get an I-551 stamp in your passport. This will allow you to travel with the Reentry Permit, as we call the I-131 in a situation like yours.

Just make sure that the person checking your mailbox will forward the Green Card to you in Japan. Also be aware that even if you stay in Japan for up to 2 years, you are required to maintain your US residency during this time period.
