Hi, I would like to ask if the sponsor's income has any effect on ROC approval. My situation now is that when I was granted the 2yr conditional GC my husband was in active duty in the Army. But then since November 2010 he joined the Army National Guard cause he is going to school and we live mostly using the Post 9/11 GI Bill. He only works part time, and I don't work since I am pregnant now. Basically, being in the National Guard has he gets less income that when he was in active duty. I am going to file my i-751 this mid June. Do you think this kind of thing (lower income) will affect the ROC? Also I would like to ask if it is okay for me the non USC to use the WIC benefits? Thank you so much for those who care to read and help me :)

Have you looked at the ROC papers and whats needed? There is no sponsorship and no income needed.

You may want to look at ROC guides.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Hi Inky, thank you for your reply. Yes, I did look at the guide for ROC. I knew that there was no sponsorship and income requirements. I just need a reassurance from someone, maybe when the time comes to deal with the immigration I am too paranoid, but thank you for your answer.

As others have said - it should not - the previously filed I-864 remains in effect. It is suggested - as part of your evidence of co-habitation/co-mingling of funds - that you send joint tax returns, but this is not for establishing income.

Also I would like to ask if it is okay for me the non USC to use the WIC benefits?

I think so, but have no real knowledge of the program - perhaps others with more information can offer their experience/opinion.
