Hi all, I filed for my wife's I-130 in jan 2011. I am a permanent resident, and it takes a long time for this type of a case, as you all know.

In the meantime, I am thinking maybe she should try to get a tourist visa and visit me for 6 months or however long is the tourist visa. I spoke with a few lawyers and they all said she would probably get rejected for a tourist visa (B1/B2?) because she has a green card case pending.

Does anyone have experience doing this? Any chances of getting a tourist visa? Would be good to know if somebody has actually succeded in doing this.

I believe they're right. On the B-2 application there's a tick box which the applicant has to tick to say "I have no visa applications pending". The B-2 is a strict non immigrant visa, by ticking that box she's declaring immigrant intent = will probably be denied IMO.

Thanks, I see what you mean. What about student visa? What if she gets admitted at a US college and tries to get a student visa?

ur wife can try to apply visa tourist without telling the consular if she has IR in USA. just try ur luck.. bcoz the consular will not check ur immigration status unless she mention it. i tried this before.

Looks like you have been lucky. But if they do check, then that may be a bigger problem.
