General Info on Naturalization

Hi All,

I am a newbie who joined this wonderful website just today. I will be filing my 5 year n-400 naturalization in August 2013. Am trying to collate all the information and be prepared. Just have 2 questions as of now.

1) I live in NYC and sometime in 2008-09 I was stopped by MTA police on the subway while walking between 2 cars while the train was in the station(not moving)!! Anyway, they gave me a $75 ticket which was duly paid within a week or 2. If i understand correctly, i need to check "yes" for citation question on the n-400 form, Do i need to dig up my old statements to get a paid out copy of the check as a proof of paid ticket?

2) I got my PR card thru job in 2008 when i was single. Got married to my lovely wife in 2011 while she was on F1. Her company is sponsoring her H1 in April 2013. My question is, while filling the section of spouse information of n-400, what immigration status should be mentioned for her. F1(which she is currently on) or H1(which is filed for her)?

As of now, i can think of these 2 questions. Will definitely look forward to be more engaged on this forum and may be able to help others!

Hi

My husband got his conditional LPR in Aug 2010 we have been married 4 years in June.

I believe he can apply to become a citizen in Aug this year 2013?

However can he submit his request 90 days early in May 2013 to get the processes started or can he not file before Aug?

Look at your greencard. Where it says "resident since...". what is the date? Add 3 years to that, subtract 90 days and that is the earliest you can apply. Keep in mind you do not HAVE TO apply then, or at anytime.

Look at your greencard. Where it says "resident since...". what is the date? Add 3 years to that, subtract 90 days and that is the earliest you can apply. Keep in mind you do not HAVE TO apply then, or at anytime.

Sorry, yes, I meant those standard items, as well. I was particularly concerned about the items below. Since these are all listed as "OR", I could send in the last item in the list (?)

4. Documents referring to you and your spouse:

to_post_off.gif Tax returns, bank accounts, leases, mortgages, or birth certificates of children, or to_post_off.gif Internal Revenue Service (IRS)-certified copies of the income tax forms that you both filed for the past three years, or to_post_off.gif An IRS tax return transcript for the last three years

They also require that "the applicant has been living together in marital union with the USC spouse in the last three years" -- do they need proof of this, as well?

Filing Fee : $595 (Add $85 biometric fee for a total of $680, where applicable. See form instructions for payment details.) No fee is required for military applicants filing under Section 328 and 329 of the INA. Applicants 75 years of age or older are not charged a biometric fee.

You almost certainly should have a biometrics fee, so $680 is the most recent payment. I highly recommend checking out the application and USCIS site for the N-400 to be sure you have the most up to date fees. :)

Hello everyone.

I am new to this thread. I went through almost all the quotes in here but still I am confused. Sorry if I missed my possible answer at some point.

I became PR on October 2008. After that I visited my country 2 times - first time I stayed there for 3 months and second time I stayed there for 2 1/2 months. Total 5-1/2 months. So can I file N400 on July 2013 i.e. 90 days before I complete the 5 yrs of my residency OR NOT???? or Do I need to add my total 5-1/2 months in July 2013 which will be then Jan 2014 to be eligible to file N400???? because in first part of this thread it is said I have to count an every single day. So???

I have a stupid question, if you had the interview and passed, are you already a citizen or do you wait until the oath taking before you are actually a citizen? ergo, do you have to wait til after oath taking before you can change ssn, driver's license, get passport, etc?
