'RICARDO4EVA2' , my husband location is in NYC, next week he plan to file petition for me, which location of USCIS should we go? i read that Vermont is taking too long to process, how bout others place? pls advise.. thanks. :help:

Good day to you. I understand the importance of being filed for and being processed in a fair and timely manner. However .... We are not able to choose the service center that will process our cases since it is determined by our addresses. Your husband is in NYC he should be assigned to the Vermont Center.

Forgive me for not answering the question. He can use and address he feels is his "re si den ce" he can live in NYC and use a different ADDRESS YES....! But will have to make the necessary arrangements (or not) once the case is at the NVC.

This is nuts. There's no reason to do this. The priority date is the day that USCIS receives the I-130 - not the day they approve the I-130 petition. It doesn't matter which service center it goes to - the priority date is going to be the same. Yes, some services centers will take longer to approve the petition, but there's a 99% chance the petition is going to be approved long before your priority date is current, regardless of which service center the petition goes to.

In the rare circumstance that your priority date becomes current before the petition is approved then you'll be eligible to proceed with NVC processing as soon as the petition is approved. You won't have to wait for "another cycle of PD".

??? that is not true...hello people do move you know... how will the have the say that it did not happen..? even if someone works in new York but has their primary residence establish in Texas then that is the address that can be used and the petition will not be sent back.

hello jim. i understand that on average the case is approved in 4-7 months with the CA / VT srv center but i guess the user would just prefer being with the center who will do a quicker process. Though - - if the PD is still not current then it does not matter.

I agree with Ricardo, my PD is October 12, 2010 and my file is still sitting at vermont no touches nothing 8 months, I know my PD isn't current but I would at least like to know my case has been approved.

yepp.. the average case at CSC was approved in 4 months...see below I would change if I could...

http://www.visajourney.com/forums/topic/285076-december-2010-filers/page__view__findpost__p__4699165

back in 2003 my granny filed for my mother in the F3 category.. she was married. Back then CSC was processing such cases in 2.5 - 3 years... they were slow..! about a year... maybe a year and half they ... when we filed July 16, 2003 USCIS sent us a notification that the case would be processed in 999 days. which is about 2 years and 10 months. . well to us that was cool.. however in May 2006 when the 999 days arrived the case was not approved.. placed in several service Request.. however did not contact any senator... which might have helped. In late 2006/early 2007 I told my my grandmother that i will call USCIS and change the address on file which would take the case outside the CSC and would be sent to the VSC which the case would have been outside of their processing times.. The case was transferred and correspondence received ..however they seemed to left th case sitting on the CSC schedule.. In January 2010 after 6.6 years or 2304 days the case still was not approved... by then the plan stared back in November where I told my brother to apply for my parents..which was done in March 2010... and was approved by USCIS - CSC in June 2010. In July 2010 the old F3 petition was finally approved.. which was of no good because we were now dealing with the NVC regarding the IR-5 petition however till now we have not cancelled the still pending Petition that was filed back in 2003.
