how to filed I-130 F2A, Please help.

Hi, im from Indonesia, I am a wife of LPR, we married this January 2011, and my husband planning to filed petition F2A for me.

I was reading a lot about this petition information from many website and here is my question, please help me…

1. is it true that visa priority date is having Retrogression, what does it mean?

2. if my husband filed petition for me next month, when will be approved by USCIS? Is it depends on the USCIS center to process? And which place do you think more quick to filed?

3. Please advice what is the step to file petition I-130F2A without using any lawyer service, coz its soo expensive.

Here is the question you should be asking:

How long is it going to take the whole process to get visa in F2A category?

Yes approval times varies from place to place at the USCIS level depending on the service center that processes your case, but USCIS is only half the way… then your case moves to NVC and stays there until a visa number is available in your category F2A.

Answer to the question above: Around 4 years for F2A category … please refer to the Visa Bulletin for current PD dates.

This is the site you are going to want to watch as it links to the current visa bulletin which gives the date they are currently processing. Currently they are processing applications with a priority date of Aug 2007 for the F2A category. Sometimes from month to month the dates have a big jump, sometimes they go backwards (retrogress), it depends on how many people actually apply for the visa when their date becomes current.

You don't need an attorney to do this, they cannot not in any way speed up the process. What will happen is after filing the I-130 (following the instructions in the guides) he will receive a receipt with your Priority date. After the petition is approved it will be sent to storage where it will sit until that date is almost current. The file will then be pulled and processing will continue.

If he becomes a citizen while you are waiting he can have the petition upgraded and you will be available to apply for a visa almost immediately.

I say do it your self .. unless there are complications with the applicant that may be an issue like hard background issues etc.

Hi I am a wife of a LPR too ,married in january 2011. February 2011, my husband file a petition through I-130(f2a), noa1 received and now counting for the days when will be my NOA2 gets approved and more days to count when will be my priority date becomes current.. I am still thinking in a positive way that visa bulletin will have its big jump.. While waiting for my husband to be USC , F2A is enough to wait than making no steps..

I would have an initial consultation with a lawyer (most charge a reduced fee for this, mine was $100 for an hour) and then do what they suggest yourself. I thought having studied this stuff for almost 2 years now that I knew all there was to know, until I sat in my lawyers office. She gave us a good action plan, hope when I thought there was none but more importantly peace of mind, and for me, you can't put a price on that.

No matter how much you know, I'd definately seek a good lawyer's advice initially, then run with their suggestions. They may come up with a plan you hadn't even thought of!

'RICARDO4EVA2' , my husband location is in NYC, next week he plan to file petition for me, which location of USCIS should we go? i read that Vermont is taking too long to process, how bout others place? pls advise.. thanks. :help:
