In-State College Tuition Can I get it now?

ok hoping that my school isn't one of those who require you to be a LPR for a year before you can benefit from an in-state tuition

it says on the 2nd page:

if you do not qualify under the rules described above, you still may qualify for in-state tuition if you have resided in New York State for at least one year, and one of the following applies:

the one that applies to me says

-- you are a US citizen, permanent resident, or have a permanent resident application pending (you must have filed Form I-485 application to Register permanent residence or adjust status, It is not sufficient to have solely a pending or approved I-130 petition for Alien Relative or I-140 immigrant petition for alien worker.

so according to this i am good right?? anyone?

I am in the same situation as you but I go to SUNY. I'm graduating Spring 2012. I found the same information;

Immigrant Aliens

Students who are not US citizens must have a Resident Alien Card, and meet the other requirements necessary for establishing residency. (If the application is still pending, you must send a copy of your passport, stamped by the I.N.S., as being processed for I-551, or a copy of the Notice of Action from the I.N.S. in response to Form I-485, Application for Permanent Residence.)

If you currently reside in New York City (any of the five Boroughs)

New York City residents (any of the five Boroughs) who have met the New York State residency requirement by maintaining a domicile in New York State for a period of at least one year preceding the date of registration must sign the residency affidavit printed on the registration form at the time of admission to the college.

For my uni, we can apply for NY State residency with the documents required above, then we're eligible for in-state tuition rate. From what I've read, I don't see that you'll have a problem with getting the in-state tuition rate.

My case is different. I can't apply for in-state tuition rate since I still have one year to go. Sad. I asked the International Student Advisor about it and he said I should maintain my F1 status (which means paying out-of-state tuition rate) until my AOS application is approved. If my AOS applciation is denied (touch wood), I'm still able to remain F1. My lawyer advised me to keep my F1 status as well.

I understand that a lot of VJers here stated that once we applied for AOS, we are no longer in F1 status - I found it confusing as well. I did some research and found different information. There's a website that mentioned; Once we use the EAD and Advance Parole, then we're no longer F1 status. So my understanding is if we maintain the requirements for F1, then we still get to keep our F1 status.

July 15th 2011 - Received EAD/AP card

Sept 26th 2011 - Online updates, Interview on Nov 1st

Sept 26th 2011 - Received Interview letter (Nov 1st,Federal Plaza,8:15am)

Nov 1st 2011 - Interview ~ Approved!

Nov 4th 2011 - Online Update ~ Card Production :D

States and institutions vary. The local junior college here in California doesn't care what your status is, but they want to see utility bills proving you have been living in the state for the last year in order to pay instate tuition.

Just the utility bill and you are in-state - they dont ask for your legal status in the country?

I am sure they ask to see either you are USC + 1 year utility bill or LPR(not sure if they check when LPR status started) + 1 year Utility bill

Dude,

you need to stop watching Jerry Springer and pay attention to politics once in a while. California law explicitly prohibits any state-operated institution of higher education to inquire about a student's or prospective student's immigration or citizenship status. They just can't do it and if they do, they are violating state law.

As someone who studied with an expired B2, first at a California community college, then at UCLA from where I graduated with a B.A., let me tell you that the requirement for California in-state tuition can be met by showing a California driver license that is (a) still valid and (b) has been issued at least a year ago. Now try to figure out how illegal aliens are able to attend college in the Golden State if they do not have a Green Card or a California driver license? Exactly!

If somebody gives you #######, you need to be able to call 'em out on it.

That means all the F1 students in CA do not have to disclose their F1 status and can study for in-state tuition after 1 year..... WOW love it..... and wonder why CA's education budgets are in reds :)

California's instate tuition "fees" are no bargain either.
